THE SUNSHINE STATION RAILWAY DISASTER
On the night of Easter Monday, 20 April 1908, over 400 were injured and 44 people died as a result of a Melbourne-bound train from Bendigo colliding with the rear of a mail train from Ballarat, which was just leaving the station. Around 1,100 people were aboard the two trains. Almost all of the casualties were from the Ballarat train, as the Bendigo train was cushioned by its two locomotives.


A clerk for Gibbs, Bright, and Co. Ltd., a produce distributor, and lived at Hawthorn, aged 41 years.

. . . The funeral of the late Harry Edwin Peake, of Ryeburn-avenue, Upper Hawthorn, was attended by a large number of friends. Deceased was a clerk in the employ of Gibbs, Bright, and Co. Ltd., and leaves a widow and young family. The Rev. Leonard Townsend officiated at the grave. . . .

ALLOTMENT OF COMPENSATION.
CASE IN COUNTY COURT.
A case, arising out of the Sunshine railway disaster, occupied the attention of Judge Chomley, in the County Court yesterday morning. One of the victims of the disaster was Mr. Harry Edwin Peate, of Ryeburn-avenue, Hawthorn, accountant. The sum of £2,000 was paid into court by the Railway Commissioners, in respect of his death, but a question arose as to how the amount was to be distributed. Mr. Peate left a widow and two young children. His father, who was an invalid, and had re- ceived an allowance during Mr. Peate's life, also claimed to share in the fund. Mr. Lewers (instructed by Messrs. Blake and Riggall), appeared for the Union Trustee Company, the administrators of the estate of the deceased. The Railway department was not represented. Mr. Lewers said that the action was brought under the Wrongs Act, and it was, therefore, necessary that the Court should decide the distribution of the money paid. Mr. Peate's father was 73 years of age, and had had an allowance from his son of 7/6 a week. Mr. Perry Edward Peate had been an accountant, in the employ of Messrs. Gibbs, Bright and Co., And had been in receipt other salary of £280 a year. It was suggested that the father should receive 4/ a week from the fund, and that the balance should go to the widow and two children, a girl aged 3, and a boy aged 2. Albert A. Peate, a brother of the deceased, said that he and his brother had contributed 7/6 a week each to the support of their father. The widow and two children had received £304 from life insurance and the sale of furniture. The widow had written to him, stating that she was receiving an allowance from her father, out of which she was able to save. He suggested that the Court should allow the father 7/6 a week.
Mr. Lewers. –The Court can deal only with the money paid. It has nothing to do with the money otherwise received by the widow.
Mr. Peate. —A capital sum of £150 would give the father 7/6 per week.
Judge Chomley ordered that the father should receive 4/ a week, and that of the fund remaining the mother should receive one-third, and the two children one-third each.
