Samuel Ervin was a son of John Witherspoon Ervin and Laura Catherine Nelson.

According to a biographical sketch written by his son Sam J. Ervin, Jr., he was educated in his father's school, the Manning Academy. After he moved to Morganton, NC, he studied law on his own and passed the bar examination in 1879. Eventually he and his son became law partners.

Mr. Ervin never stopped studying the law. He was a trial lawyer of some renown in the state of North Carolina. He maintained that the United States Constitution was "the guardian of our liberties", a statement that was to have great impact on the nation as a whole years after Mr Ervin's death. Sam J. Ervin, Jr. stood up for his and his father's strong belief in the U.S. Constitution during the Watergate hearings.

He was a well-read man and his favorite quotation was "A lawyer without history or literature is a mechanic; a mere working mason; if he possesses some knowledge of these, he may venture to call himself an architect." (from Guy Mannering ).
