Joab was the son of Thomas and Anna Cheek Parks. He married Lucy York Jan 16, 1825 in North Carolina.
Between 1840 and 1850 Joab and some of his children, along with brothers, John, Fields and Henry, moved from Parks Crossroads, NC to Dresden, TN.
There was a rift in the family over the estate and caring of their father, Thomas Parks. Brother, George Washington Parks and wife, Malinda, cared for the ailing father in NC.
Testimony in this case indicates that Thomas Parks died intestate, and that John Parks felt that Wash Parks used too much of their father's estate while caring for Thomas in his final days.
The court case includes depositions taken in October of 1855 and April of 1856, four years after the death of Thomas Parks. The depositions were taken at Foust's Store. Persons deposed included Anderson Craven, I.H.Foust, Wm G Stout (son of Jacob Stout), Dr C.E. Graves, John Henley and Crabtree Syler.
Testimony indicates that Thomas Parks was extremely trying and difficult to care for because of his debilitated physical and mental state. The doctor who attended to Thomas Parks following his first accident admits that there was no amount of money that could be paid to him to care for the old man in the way that Washington and Malinda Parks had. Even Milley Rains, Thomas' surviving daughter, expressed admiration for the job that Malinda Parks had done, and acknowledged that she could not have taken care of her father the way that her sister-in-law had done. According to testimony, Thomas Parks was given to 'cursing and swearing,' and delusions and 'partaking of spirits.
