He was the son of Benjamin Walter Staton and Lucinda Bishop Staton.
At the time of the Civil War his family lived in the area of Henderson and Polk counties in North Carolina.
His first wife's first name was Mary. His second wife had the first name of Frania.
He enlisted in the Confederate 64th N.C. Infantry Regiment, Co. B, on 7-12-1862 at the age of 18 in Henderson County, North Carolina. He was confined in 1864 at Louisville, Ky., and released 11-25-1864.
