Son of Granville Rutherford, a farmer and Baptist preacher, and his wife Rachael P. Eades Rutherford. They were both born in Bourbon Co., Kentucky and came early to St. Louis County, Missouri, then to Franklin County.

James wasn't living at home with his parents in 1850.

James Rutherford and Mary Ann Elizabeth Walker both of Franklin Co., Mo. were married on 16 October 1856 by Jesse Shelton, JP at Franklin Co., Mo. Pg 317.

James and Mary's second child, Sarah Luella, was born in February 1863.

Sometime between 1860 and 1870, James and Mary moved from Boeuff Township to near Gray Summit. James's father, Granville, had died in 1866 and it may have been after that they moved. In 1870, they were living next door to Mary's parents on 40 acres of land on the east side of Coleman's Road. Mary's parents, Grieves and Sarah Walker, lived on 120 acres on the east west side of the road. Their little daughter Ella listed on the 1860 census seems to have died, but they have three new children:

Mary's mother died in 1883 and her father in 1891. She was the sole heir of their very considerable estate, but no will or probate papers have been found.

The Altamont High School was attended by Rutherfords (maybe the two youngest, Frank and/or John?) sometime during 1894-98:

"Altamont High School -
Several small private high schools were in existence for a few years during an era when high schools were almost non-existent in the county. The Altamont School was the brainchild of three men who, in 1894, were anxious for their children to receive a higher education. Andrew Morgan "Boggie" Groff, Fergus Ferguson "Ferd" Disharoon, and J. A. "Parson" Miles decided to put up the capital for the land and building and to charge tuition, using the fees collected to pay the teacher's salary. It was located in the Gray Summit area on the Groff property but only existed for four years. The first year, it was taught by Bertie Sweet. E. C Rohrbach taught the remaining three years. A charming account of the four years of Altamont School can be found in the book, Diamond Dust, whose author is listed as "The Salvager," but who was obviously one of the Groff children, probably Spencer Groff. According to the book, this school served the Groff, Disharoon, Miles, Sweet, Bannon, Lay, Triplett, Rutherford, Peanick, Stanley, Tyler, and Davies familes."

A portrait of the family was done about 1909 in front of their daughter Luella Bell's farmhouse. James and Mary sit in the center of the group with their children, their children's spouses and some of the grandchildren grouped around them.

In 1910, John and Mary were living alone next door to their married daughter Luellen Bell and her husband and children. Their son William and his family also lived very close by:

Mary died on 9 Jul 1922. She left no will that is still on record, but daughter Luella Bell was appointed administrator of her estate. Her real estate ("the farm") was valued at over $7,000, a large amount for the time.

James and Mary's graves are currently unmarked, but according to a granddaughter there used to be bronze markers on their graves on the slope just above those of her parents Grieves and Sarah Walker (in the photo, their tombstone lies flat on the ground on the left).

James's death certificate states that he was buried in Brush Creek Cemetery.
