Massena Young Man Held On Manslaughter Charge In Death of Aged Farmer

Charged with first degree manslaughter, Donald McCaffrey, 22, 500 S. Main St., waived examination yesterday afternoon before Police Justice John W. Whalen. He was held for the action of the St. Lawrence County Grand Jury which convenes
in September.

Joseph Lavine, 67, farmer on the S. Racket River Rd., died Sunday night enroute to Potsdam Hospital in an ambulance. He was taken to the hospital following an altercation at Red Jack's Restaurant, 425 S. Main St.

Dr. F. W. Porro, Ogdensburg, conducted an autopsy yesterday noon. The autopsy revealed that Mr. Lavine suffered a broken nose, a bruise on the forehead and right arm and severe concussion. His skull was not fractured.

Dr. R. H. Gelder,Winthrop, coroner, will conduct an inquest in Massena tomorrow morning at 10 o'clock.

Chief of Police Darwin D. Shatraw and Assistant District Attorney Charles Bowers, Canton, conducted a complete investigation yesterday, interviewing a number of witnesses.

According to the information gathered by Chief Shatraw, the two men were standing at the bar. McCaffrey asked the older man to buy a drink. Lavine ordered drinks but the bartender refused on the grounds that it was after closing hours for the bar.

It was then that McCaffrey pushed or threw the older man to the concrete floor.

Lavine was unconscious when he was picked up from the floor, having fallen face downward. He was brought to Massena police station and Dr. Philip Mardon summoned. Dr. Mardon gave treatment and ordered that he be sent to Potsdam
Hospital. He was taken in the Donaldson ambulance.

Assistant District Attorney Bowers came to Massena yesterday afternoon after attending the autopsy. McCaffrey was then arraigned on the manslaughter charge. He was taken to the county jail today.

The body of Mr. Lavine was brought to Massena yesterday to the Phillips undertaking parlors. Arrangements have been made to hold funeral services Wednesday afternoon in the Methodist Church at 2:30.

Mr. Lavine was born in Massena in June 1874, son of Mr. and Mrs. Peter Lavine. In early life he married Miss Jennie Lavine, no relation. Surviving are the widow; one son, John Lavine, who resides on tho S. Racket River Rd.; two sisters, Mrs. Annie Sucese and Mrs. Orin Carbino, both of Massena.

Mrs. Lavine resides in the village at the rear of 36 Martin St. Mr. Lavine lived on the farm which he owned. Mr. and Mrs. Joseph Stiles operate the farm. Mrs. Stiles is a granddaughter.

Donald McCaffrey was arrested by Massena police Dec. 30, 1939 on a charge of unlawful entry. He broke into the VFW hall on S. Main St. on Jan. 30, 1939 he was placed on two years' probation on that charge. He was arrested by state police at Canton Mar. 20, 1940 on a charge, of violating the motor vehicle law. Sentence was 10 days and a fine of $50.
