On this 21st day of March in the year 1835 personally appeared before John H. Thompson President Judge and Enoch Parr [?] and William Phelps the Associate Judges of the Circuit Court here in and for the said County of Washington and State of Indiana aforesaid in open court in session held at the Court house thereof in the town of Salem Nathan Smith a resident of the Township of Franklin in the said County of Washington and State of Indiana as aforesaid, aged about Eighty two years who being duly sworn according to law doth on his oath make the following declaration in order to obtain
the benefit of the provision made by the act of Congress passed June 7th, 1832.

That he volunteered and joined a company of militia in which he entered the service of the United States under Captain Arbuckle of the Virginia militia in the County of Frederick in the State of Virginia immediately after that he (declarant) was twenty one years of age and marched in said service against the hostile Indians then on the Frontiers for the term of six months which was in or about the year 1775 as nearly as he (declarant) can now recollect that during that term of Service he was with said Company under Captain Arbuckle, Colonel John Tipton and Major Burns [could be "Burris"] at a Garrison or Stationed on the Frontier in Greenbrier [County] in the State of Virginia. That after he (declarant) was in this service six months on the Frontiers as above stated he was verbally discharged with all the rest of Company at the Garrison. That he (declarant) afterwards enlisted in the Army of the United States in the month of March in or about the year 1776 when he (declarant) as near as he can recollect was about upwards of twenty two years of age under Captain Jonathan Langdon he (declarant) believes in the Virginia line at Woodstock or Millerstown in Shenandoah County in the State of Virginia where he was and in the vicinity kept until the next year during a part of which he was confined by sickness and unable for service that the next year after he had enlisted and recovered sufficient for service he was marching to different places part of the time at Winchester Virginia where he thinks that as well as he can recollect he was under the command of Major Taylor a part of the time at the least.

That during some time of the next year after that he (declarant) enlisted he was marched with other troops to the State of NC where he was under the command of Colonel Morgan [Daniel Morgan] and General Greene [Nathanael Greene] of the regular officers of the Army of the United States in the Revolution – that he [declarant] fought against the enemy at the Battle of King's Mountain in the State of NC [sic, SC]. That he (declarant) recollects that he was in that part of the troops on that occasion under Col Benjamin Cleveland – that he recollects that Col Shelby [Isaac Shelby] whom he saw there was also commanding in the Battle of King's Mountain that Captain or Major Lewis of the American Troops was killed in that Battle whom he (declarant) knew that he (declarant) was an and fought under Genl Greene at the Battle of Guilford [sic, Guilford] in the State of NC that after the Battle of Guilford he (declarant) was marched under Genl Greene to Camden to find the enemy afterwards he (declarant) marched to Savannah under Genl Greene and also to Augusta where they remained some time then returned through a part of North
Carolina and South Carolina to the State of Virginia and afterwards back into the State of North Carolina on the Adkin River [sic, Yadkin River] where he (declarant) was discharged.

After that he had served his full term of three years as aforesaid that he received a regular discharge in writing which has since been lost but where or how he cannot now well recollect he took no care of it not thinking that it would ever be of any material benefit to him. That he (declarant) recollects that he was under different captains and other officers many of them whose names he cannot now recollect in consequence of his memory and mind failing much during several years past. That he (declarant) also recollects Col Williams [James Williams] of the American Army at King's Mountain and Captain or Colonel Herring [?][ this may be a reference to Capt. Benjamin Heardon of Frederick County Virginia who is believed to have been at King's Mountain]. That he (declarant) suffered much at the Battles of King's Mountain and Guilford at both of which there was hard fighting and suffered very much by hard marches night and day by heat, wet and cold through all the different seasons -- And that he (declarant) has never received his pay for his services.

That he (declarant) has never had any record of his age by which to determine the time of his birth. That he was born in Frederick County in Virginia as above stated where his mother died when he was about four years of age that his father put him (declarant) an apprentice when he was about 15 years of age with one Benjamin Agin [?] in Frederick County Virginia to learn the art of Taylor [sic, tailor] that when he (declarant) was about 18 years of age his father also died at Frederick aforesaid that he (declarant) was free from his apprenticeship at the age of twenty one years and shortly afterwards he entered the service in the war during the revolution under Captain Arbuckle against the Indians as above stated.

That after he (declarant) was discharged from his three years service in the United States war of the Revolution as above stated he married in the County of Frederick in the State of Virginia aforesaid where he remained until about four or five years or upwards after he was discharged from the service when he removed to Wilkes County in the State of NC with his wife and three children where he remained about six years or upwards residing about 18 miles below the Wilkes County Court house then he removed to Burke County NC where he resided about 20 years or upwards then he removed to Knox County about 10 miles from Knoxville and the State of Tennessee where he resided about four years or upwards then he removed to Adair County in the State of Kentucky where he resided about four or five years or upwards then he removed to Franklin Township in Washington County in the State of Indiana where he has resided ever since about eight or nine years or more or upwards and where he now resides as above stated that his (declarant's) recollection of times and durations, persons and names is faded and very imperfect

That he (declarant) states as follows first
1. That he was born at the place and about the time as above stated.
2. That he has not ever had any record of his age.
3. That he was living when he entered the service and has since the Revolutionary War and now resides at the places as stated as aforesaid.
4. That he always entered the service as a volunteer or enlisted man as above stated and not otherwise and that he never was drafted nor was he ever a substitute.
5. That he can state the names of the regular Officers who were with the troops where he served such Continental and militia troops and the general circumstances of his service as above – imperfectly stated from the best of his now impaired and imperfect recollection and no more as he now recollects.
6. That he received a discharge from the service as above stated and that the written discharge was long since lost or destroyed by some means not known or now not recollected as aforesaid. And that he never received any commission. And that he always served as a private and not otherwise.
7. That he is known in his present neighborhood to Genl Joel Combs, Captain John Parr, Judge Samuel Huston, Edward Norris, James Sturtevant.
He (applicant) hereby relinquishes all claim whatever to a pension or annuity except the present and that he declares that his name is not on the Pension roll of any Agency in any State.
