His burial records are found in Early Settlers of New York State by Janet Wethy Foley.

He was the son of William Bay of Maryland. William Bay's ancestors were originally of French Huguenot stock.

John Bay graduated from Princeton in 1765 after studying law and soon settled in Albany, New York. One source suggests that he went to Albany because one of his uncles was a cleric who was assigned there. He married Hannah/Anna/Ann Williams, an innkeeper's daughter, at St. Peter's Anglican Church in December of 1769. He worked as a teacher and then possibly an attorney at Albany.

During the Revolutionary War, he and his wife moved to Claverack, Columbia County, New York after he had declared for the American cause at Albany in 1775 and signed the "General Association" in 1776. At Claverack, John Bay was exempted from active military service but served on a Committee of Safety which probably gave him that exemption. He was given Land Bounty Rights after the Revolution was over.

The couple had at least five children (four sons and a daughter Jane according to a couple of sources. Two of the children were physicians and one was an attorney.) There is a possibility that there was another daughter Mary. Jane married William W. Van Ness, Jr. (1775 to 1823), a prominent lawyer of Columbia County, New York, who died at Charleston, South Carolina where he had gone because he was in ill health. He is buried at the Dutch Reformed Churchyard of Claverack, Columbia County, New York but I don't know the date of death or other pertinent similar information for his wife Jane (Bay) Van Ness.

After the war was over, John Bay had a significant legal practice at Claverack and served in the New York State Assembly from 1779 to about 1795. He died in 1818 and his wife outlived him by more than 25 years.

One of his children, who became a prominent physician, was Dr. William Bay, born at Albany, New York on October 14, 1773 and died Sept. 7, 1865 at the age of 92 years. He attended Princton University and married Catherine Van Ness, a sister of Judge William Van Ness. They were married in 1797 and she died Jan. 24, 1864.
