Mary Benney was born in Baltimore, MD. She was the child of David and Arminda Johnson Benney.

Mary had a child out of wedlock with Calvin Rearick in 1888 in Union County, Pennsylvania, where they were living. In October of 1888, she swore out a warrant against him for "bastardy" and had him and his father, Andrew, brought to court on $300 bond.

The case was dropped, as Mary and Calvin were married on 17 Nov 1888 by a Justice of the Peace in Union County. Mary's parents, signed a document consenting for her to marry. (In this document they give the particulars about their identities as her parents and her birth date and place.)

About four months later, Mary was back in court charging Calvin with desertion as "he had left her." It is probable that Calvin left for Minnesota about this time and joined other family members in Polk County,

After her divorce from Calvin, Mary married Charles F. Thoms. No further records of Mary Benney Rearick, or her child, have come to light. While her name is on the grave marker for Charles F. Thoms, the birth date is wrong (at least by a decade with regards to the 1910-1930 census and even further compared to the date given in her marriage certificate to Calvin Rearick). It is not completely certain that she is actually buried in this plot.
