According to his pension application,
Elihu Littleberry Kirksey was a member of Cocke's Company, Benavides' Calvary Regiment, Ford's Brigade, Rio Grande Division, CSA. Many of those who were recruited for this unit in the latter part of 1863 were boys and older men. Elihu was barely 17 when he joined this unit. This unit primarily saw service during the war along the border with Mexico and participated in the last battle of the Civil War, the Battle of Palmito Ranch. The Union sought to control the border to prevent the Confederacy from selling its cotton, its main source of revenue during the war.

Elihu was too young to have served in Company K of the 17th Infantry, but his father John M. and his uncle Ervin L. did serve in this unit. His uncle died in the Battle of Milliken's Bend, Louisiana, and was buried on the battlefield.

At some point there was some confusion resulting in the younger E.L. Kirksey's grave being marked with the wrong unit.
