NOTES:

1. Martin Grader, husband of Veronica a.k.a. Frances/Franie, died sometime prior to September 15, 1770. Martin probably died two to three months earlier as it is apparent from the documents that discussion between family members had been going on for sometime on the valuation and division of Martin's assets, without resolution. The family members apparently reached an impasse, causing Casper Weber, husband of Maria Grader Weber, to file a petition with the Orphans Court. It is obvious that there must have been a difference in perceived valuation among family members. Probably the usual difference that exists between a buyer and seller. In this case, Christian the buyer, and his siblings the sellers. They probably asked for the "moon" and he offered them a "handful of dirt."

2. The ensuing court actions probably caused some bad feelings within the family toward Christian and may be the reason that his brother Jacob, sister Esther and their respective spouses, Elizabeth Moyer Grader and John Moyer, moved to NC. It is interesting to note that in Jacob's line of descent, that all his brothers and sisters names have been given to his descendants, except Christian. This appears to be akin to "writing Christian out of the Bible." It will be interesting to find out what happened to his brothers, Daniel, David, John, Samuel and Christian.

3. It is amusing to read in several of the court documents, in which they refer to Frances as:
"the widow Frances, relict of the deceased."

DOCUMENT - 1 CASPER AND MARIA'S PETITION FOR VALUATION

Petition by Casper Weaver of Upper Milford Township of Northampton County to the Justices of the Orphans Court of Berks County on September 15, 1770. The writ was tested on Sept. 17, 1770 before James Read, John Patton and Henry Christ, ESQS. On the cover sheet, the notation "Read & Granted." The writ was granted on Sept. 25, 1770 and ordered to be heard on 13 Nov. 1770. On the cover page, the name Casper Weaver is written. In the body of the petition the name, in different hand writing, is Caspar Weber and his wife Maria, the late Mary Grader, one of the children of Martin Grater. Maria is not deceased, late as used in this instance means previously known as. Also in the body of the document, all the children are named, including the spouses of the daughters. Maria, wife of Casper Weber; Elizabeth, wife of Jacob Sleifer; Esther, wife of John Moyer; Margaret, wife of Henry Weber, with the spelling of the names as shown. At the end of the petition, it is signed in different handwriting and in very bold large script as Casper Weaver and below his signature in a smaller bold script, is the signature Anna Maria Weber. The signatures appear to be in the same handwriting and style. It is my opinion that the attorney representing them, signed their names. There is no (x) by either signature. Also, it is obvious that whoever wrote the petition, that English was their first language.

The petition requests the court to order an inquest into the partition of the Real Estate of Martin Grader of Hereford Township in the County of Berks, who died intestate. The petition requests that if the partition of the Real Estate cannot be made without Prejudice to spoiling the whole of the same, that the inquest should put a value on the Real Estate and offer Christian, the eldest son, the right to pay off the other children and widow, their fair shares of the valuation. The petition also requests that should Christian, the eldest son, refuse to accept this offer, then the next eldest son shall have the right to accept. On refusal, the offer shall pass to the next eldest son. If none of the sons accept this offer, then the petitioner or any daughter older than Maria, who will accept herself, may hold and enjoy the same Real Estate in an ample manner as the Intestate held the farm at the time of his Decease, upon paying to the other Children and to the Widow their final (obligation?). I have and pray parts of such Valuation, in such manner as by the acts of General Assembly of the Provisions for settling Intestate Estates is particularly directed.
