Last Will and Testament & Codicil of Henry M. Burns
Recorded November 7th 1873 in Wills Book G, pages 423, 424, & 425. Joel F. Thornton, Ordinary.

Georgia, Greene County. I do solemnly sweat that the within and foregoing writing contains the last will of the within named Henry M. Burns, Dec'd, so far as I know or believe and that I will well and truly execute the same in accordance with the laws of this state, so help me God.

Sworn to and subscribed before me in open court this November 3rd 1873.

Georgia, Fulton County. I Henry M. Burns of the County of Greene and State aforesaid, being feeble in body but of sound mind, do make this my last will and testament, hereby revoking and annulling all others by me heretofore made.

Item 1. My soul I commend to God who gave it – and I direct that my body be buried in a decent and Christian-like manner in the cemetery in the city of Greensboro, Greene County Georgia – and that a marble head and foot board be placed over my grave and that a suitable inscription be engraved on the head piece, my name and age to be included in the same.

Item 2. I give to my brother John P. Burns of Dadeville, Alabama, my watch and chain – and to my nephew Henry Burns, son of said John P. Burns, I give all my books and the files of the Greenesboro Herald newspaper – during the time I was Editor of the same – also the bundle of papers containing my correspondence during said time.

Item 3. My will is that my house and lot in the city of Greensboro, Greene County Georgia shall be sold – and I hereby give my Executor full power and authority to sell the same publicly or privately, and I desire said sale to take place as soon after my death as the interest of my estate may seem to justify – and further my will is that all my property to wit – notes and accounts and everything of any kind whatever that may belong to me at my death, except what is mentioned in Item 2 of this will – shall be converted into money as speedily as possible – and after the expenses which will necessarily revert to my estate in the execution of the 1st Item of this will are paid – and all other expenses attending the execution of this will – and also after the payment of all my debts if any – my will is that what remains shall be divided into two equal shares. I give and bequeath to my sister, Mrs. Martha Ann Morgan. The other share I give and bequeath to my sister Mrs. Mary J. Mann of the counties of Chambers & Tallapoosa, Ala.

Item 4. I hereby constitute and appoint my friend Columbus Heard Executor of this my last will and testament. This September 25th 1873.

Signed, sealed, declared and published by Henry M. Burns as his last will and testament in the presence of us, the undersigned, who subscribed our names hereto in the presence of said Testator at his special instance and request and in the presence of each other. This September 25th 1873.

C O D I C I L

Georgia, Fulton County. I Henry M. Burns, desire and direct that my Executor shall turn over all the property mentioned in the second item of my will to John P. Burns. I further desire and direct that my Executor shall pay the debts now due and owing by my father Darius Burns, provided the same do not exceed the sum of three hundred dollars.

The sums going to my two sisters under the third item of my will are each to be equally diminished in consequence of the payments of said debts of Darius Burns. I further desire and direct that my Executors shall invest the money bequeathed to my said two sisters in real estate, the same to be chosen and selected by said legatees, and that said
Executor have the deeds to said real estate made to said legatees and the heirs of their bodies now borne and to be borne.

This writing is to be a codicil to my will made and published on the 25th day of September 1873 in the presence of Jas. B. Park, W. A. Haygood and H. T. Lewis.
