Veteran of the War of 1812.
James and his brother John Nay (1791-1813) were two of the 4,000 mounted volunteers who gathered at Newport, Kentucky, on July 31, 1813. They marched from Cincinnati to Urbana, where an arms depot awaited them. There, on August 27, they were mustered into Capt Edward George's Company, which was part of Col John Calloway's Eighth Regiment. On September 9 they marched northward. Landing on the Canadian shore of Lake Erie on September 27, this 'Army of Kentuckians' engaged in the Battle of the Thames on October 5, 1813.

A farmer and road overseer, James and his wife Elizabeth became members of Eighteenmile Baptist Church in 1812. James died from typhoid fever, aged 66 years. The division of his real estate after his death was recorded on April 24 and September 11, 1856 (see Oldham County Deed Book J, pp. 101-107). His property, consisting of a home tract of 360¾ acres and another on Brush Creek of 56¼ acres, was divided between his children and heirs: William Nay, Jemima Nay, John Nay, James Nay, Joel Nay, Margaret (wife of William H. Head), Harriett (wife of William S. Bennett), Ann (wife of A. J. Fendley), and Mary E. "Polly" Jett.
