A legal notice was placed in THE QUINCY DAILY HERALD, Sept 2, 1858. William Stewart - Nancy's husband - died in 1857. The defendants in the case were Nancy and her children.

Notice is therefore hereby given, on the Chancery side thereof, and that a summons has been issued against the said defendant first above named, returnable on the first day of the next term of the said circuit court, to be holden at the court house, in Quincy, on the fourth Monday in the month of October next, and that unless said defendant be and appear before said circuit court, on the return day of said summons, and answer the said complainant's bill of complaint, the allegations thereof will be taken as confessed against them and a decree entered according to the prayer of said bill.

Mary's father: James Marston

"JAMES MARSTON was born in Durham, N.H., Aug. 8, 1789, and came with his parents to Cutler, Me., about A.D. 1800.
He married Mary Grant, March 24, 1806, and resided in Cutler till 1835, then moved to Flushing, L.I, thence to Illinois, and died on board the steamer on the Illinois river, en route, Oct. 2, 1840, aged 41 years. He was a master mariner, and had 12 children.

"LEVI MARSTON, was born (probably) in Newmarket, N.H., Feb. 18, 1755; m. 1st, Mary Rand, May 10, 1780, and resided in Durham till 1791, then removed to Effingham, thence to Prospect, Me., about 1798; then again, soon after, to Cutler, Me. He perished with the cold in an open boat while on his way home to Cutler from Eastport, Jan 27, 1809, during a bitterly cold snap. The boat was afterward found, and he was buried on the island of Grand Menan, N.B. He was a blacksmith by trade. He had nine children. Md. 2d, Miss Richardson."

"JAMES MARSTON was born in Newmarket, N.H., about 1732; md. Phebe (Pease, probably), in 1754. By a deed to his brother Caleb, of Newmarket, March 16, 1768, he was living in Canterbury, probably one of the original proprietors, but he moved to Chichester, where he died in 1775-6, aged about 43 or 44 years. He was a blacksmith. Phebe was appointed administratrix April 30, 1777, and Thomas Hunneford and Nathaniel Pease of Newmarket were her sureties.

"CALEB MARSTON, was born in Hampton., N. H., May 19, 1672; md. Anna Moulton about 1696, and settled in North Hampton on the homestead, where he died in April, 1747, aged 75 years. He will was made April 22, 1746, and proved May 27, 1747.

"ISAAC MARSTON, was born in Hampton, N. H., A.D. 1647-8; md. Elizabeth Brown, Dec 25, 1669, a daughter of John and Sarah (Walker) Brown. She died Oct. 5, 1689, and he married 2d, Mrs. Jane (Brackett) Haines, April 19, 1697, widow of Matthias Hanes, Sr. He was made freeman, April 26, 1678, and was selectman in 1681. His farm was on "North Hill" (now of North Hampton), and is the same now (1886) occupied by David Simon Narston, who is the sixth generation of this name who have owned and lived on it. Isaac was living in 1714, and deeded land and buildings to his son Thomas.

"THOMAS MARSTON, eldest son of William, Sr., was born in England, probably Yorkshire county), about May or June, 1617, and came to Salem, Mass., with his father in 1634, and went with him to Newbury about 1637; thence to Hampton, N. H., in October, 1638, where he married Mary Estow ab out 1647, a daughter of William Estow, Esq. Being past twenty-one years of age, it is very probable that he had a grant of land from the General Court, as did the other pioneers; then he bought land of John Sanborn, May 25, 1645, and lesed a house and lot from Robert Knight, which formerly belonged to to Robert Marston, Oct. 5, 1653.

The provincial records show that he was a capable and highly esteemed citizen, and was prominent in the town's business affairs, and in all matters appertaining to the interests of the community. He died testate, in Hampton, Sept. 28, 1690, aged seventy-three years and about seven months, (See his will.)[Listed in the book pp. 12 - 15]

"WILLIAM MARSTON, Sr., patriarch of the Hampton, N. H., branch, was born in England (tradition says Yorkshire county), about A. D.. 1592, and came to Salem, Mass., in 1634 with his family (and probably two brothers, Robert and John), and resided there about three years, receiving a grant of land in 1636 from the General Court of Massachusetts, but soon after went to Newbury for a short time; thence, in October, 1638, to Winnecumet, where he with
fifty-five others settled on the lands granted them by the General Court of Massachusetts, and they called the place Hampton (Norfolk county), after the English home of a part of the settlers, and by this name it was incorporated.

It is quite probable that his first wife lived till about 1660. Then about 1662, when about seventy years old, he married second, Sabrina Page, aged eighteen or twenty years, a daughter of Robert and Lucia Page, of Ormesby (Yarmouth), Norfolk county, England, by whom he had one daughter, Tryphena.

He was a kindhearted, benevolent, and godly man, and was a member of the Quaker or Friends, church, and suffered persecutions for his religious tenets. He often harbored and aided his distressed and persecuted brethren, for which Christian deeds he was robbed by exorbitant fines by the zealous and bigoted courts. In Felt's Annals of New England I find this record:

'Oct. 14, 1657, William Marston petitioned the court at Hampton, that the fine of L15 may be remitted that had been imposed on him for keeping a paper and two books which inculcated Quaker doctrines.'

He died in Hampton, June 30, 1672, aged about eighty years. See his will. [Page 8 in the book.]
