Weaver was born in Pryor, Indan Territory, in 1894 to Tapley Marmaduke Rushing and Muzetta Bell Scroggins. He passed away in Boulevard Hospital, Fort Worth, Texas, from congestive heart failure. He was 69 and married. Weaver was a vetern of World War I and a retired inspector with the U.S. Corps of Engineers.
