His middle name was believed to be Franklin, but the source of this information is unavailable at this time and appears to be erroneous. Information submitted by descendent Daniel B. Troublefield states that he had a grandson named James Franklin Simril.

Obituary, South Carolina Newspaper Marriage & Death Notices, 1823-1865. "Died at his residence in this district, on Tuesday 13th inst; James Simril, Sen. 75th year of his age. A worthy and respectable citizen".

He was reported to have "lived almost right at India Hook Church, 5 miles from Ebenezer Church".

Will of James Simril State of South Carolina

State of South Carolina York District

In the name of God Amen. I James Simril being of Sound and disposing mind and memory but weak in body, and calling to mind the uncertainty of life, and being desrious to dispose of all such worldly estate as it has pleased God to bless me with, do make and ordain this my last will and Testament in manner and form following That is to say.

1st. I desire that a sufficiency of my personal property not herein specifically bequeathed my horses cattle, Hoggs Wagon House hold and kitchen furniture Shall be sold and out of the Proceeds of such sale all my just debts and Funeral expenses shall be paid and the balance to be applied by my Executor hereinafter to be nominated and appointed as shall be herein after directed.

2nd. After the payment of my just debts and Funeral expenses I give and bequeath to my beloved wife Jane Simril my negro woman named Hannah and her child Harriet together with their future increase, during the term of her natural life and at her death said Woman and child and their future increase shall be sold by my Executor.

3rd. I will and bequeath the sum of Three hundred dollars to my Daughter Jane Rosinda Simril to be paid to her within Two years after the death of my said wife out of the proceeds of the sale of the negroes referred to in the proceeding clause of this my will.

4th. I will and bequeath to my Daughter Mary Emeline Simril the sum of three hundred dollars to be paid out of the proceeds of the sale of the negroes specified in the Second clause of this will. And the balance of the proceeds of such sale shall be equally divided between my children Andrew B. Simril, William D. Simril, Jane Rosinda Simril and Mary Emeline Simril.

5th. It is also my will and desire that my wife after my death should reside on the plantation on which I now live during her natural life and to be maintained and comfortably supported of the proceeds of said plantation so long as she may live.

6th. I will and bequeath the Tract of land whereon I now reside to my sons Andrew B. Simril and William D. Simril jointly subject to the support of my wife as specified in the 5th clause. And if the said Andrew B Simril die before the said William D. Simril and without children than the said interest of him the said Andrew B. should go to the said William D. Simril and if the said William D. should die before the said Andrew B. and without children his interest in the said Land shall go to the said Andrew B Simril and his heirs forever.

7th. I also Will and bequeath to my son Andrew B. Simril my negro boy named White to him and his heirs forever.

8th. I also Will and bequeath to my son William D. Simril my negro boy named Henry and my sorrel Filley called Flag to him and his heirs forever.

9th. I will and bequeath to my daughter Nancy E. Hogue the sum of Two Hundred dollars to be paid out of the balance of the sale of the Property to be sold under the first clause and the proceeds of the sale of the Tract of Land herein after ordered to be sold, Said sum to be paid within Two years after my death.

10th. I will and bequeath the sum of Two hundred dollars to my Grandson Robert Eaton Simril Eldest son of Miles G. Simril Said sum to be held by my Executors in trust for his use and benefit (until he arrives at the age of twenty one) to be raised also out of the sale of the same property referred to in the preceeding clauses.

11th. I will also that my said Executor at my death should sell my tract of Land Lying on the Catawba River in York District adjoining Lands of James M. Harris, John Hart and Jesse Brumfield Esqr known as the Fish Trap Shoals Tract to execute titles for the same and apply the proceeds as directed to the payment of the legacies referred to in the 9th and tenth clauses above and the balance to be equally divided between my children Andrew B. Simril William D. Simril, Jane Rosinda Simril, and Mary Emeline Simri

12th. As to my other children Salina Kendrick, Franklin H. Simril, Miles G. Simril, and Violet D. Simril. I have already done a good part by them and therefore give to them each one dollar.

13th. And Lastly I do constitute and appoint my said son Andrew B. Simril my sole executor of this my last will and Testament hereby revoking all others heretofore by me made. In testamony hereof I have hereunto set my hand and affixed my seal this the 15th day September 1850. Signed sealed and declared as and for the Last will and Testament of the said James Simril in the presence of us

Codicil And whereas, since executing the above will my mind has undergone some slight change I make this as a codicil to the above will. 1st. Whereas in the tenth clause I have willed Two Hundred dollars to my grandson Robert Eaton Simril, son of Miles G. Simril I now will to him one hundred and fifty dollars to be paid as directed in said clause 2nd. I will and bequeath to my other grandsons James Franklin Simril and James Benjamin Hogue each one hundred and fifty dollars. The said sums of money mentioned in this and the first clause of this codicil to be contributed by each of the legatees named in my will except those mentioned in the twelfth clause of the Will Signed and sealed in this 2d day of May 1851 in presence of James Carothers, Austin Garison, John A.
