Know all men by these presents ~ That Whereas application hath lately been made by me Robert Akers of Bedford County, to the land Office of Pennsylvania, for a grant of a Tract of Land, containing Four hundred acres including an improvement adjoining lands of Job Higgins, on the West, in Providence Township Bedford County ~ In Pursuance whereof, a Warrant or order hath been, or is to be issued, for the Surveying the same for my use ~ Now Know Ye, that I, the said Robert Akers, for the consideration of Five Shillings Specie, to me in hand paid by George F. Alberti of the City of Philad. Physician the receipt whereof is hereby acknowledged ~ have granted, bargained and sold, and by these presents do grant, bargain and sell, unto the said George F. Alberti, and his heirs, all that the above mentioned tract of Land, with the appertanances; and all my right, title, claim and demand whatsoever, of, in and to the same, and every part thereof, and of, in and to all and Singular the lands and tenements whatsoever, which may be granted or surveyed, by Virtue of the above mentioned application, or of any Order or Survey, issued, or to be issued in pursuance thereof: To have and to hold the said Land and Premises, with the appertenances, unto him the said George F. Alberti, his heirs and Assigns, to the only proper use and behoof of him the said George F. Alberti, his heirs and assigns forever; subject to the purchase money, fees, and taxes already due, or hereafter to become due thereon ~ In Witness whereof I have hereunto set my hand and seal, the 28th day of November, in the year of our Lord, one thousand seven hundred and ninety six.

This Indenture made the June 6th day in the year of our Lord one thousand eight hundred and five. Between Robert Akers of the Township of Providence, in the County of Bedford and Commonwealth of Pennsylvania yeoman & Nancy Akers his wife of the one part. And Ephraim Akers of the same Place of the other Part.

Whereas the Supreme Executive Council of the said Commonwealth by their Patent under the great Seal of the said Commonwealth and dated the third day of December one thousand seven hundred and eighty eight, did for the consideration therein mentioned grant and confirm unto a certain Jonathan Buck a certain tract of Land called "Buckingham" situate on Brush crick, and Roaring run in Providence Township Bedford County Beginning at a Post near the north West side of said crick opposite the mouth of said Run thence crossing the crick and up said run south fifty nine degrees east two hundred and seventy four perches to a Post, thence by Stoney Barrans, South twenty six degrees, West one hundred and eighty six Perches to a Pine, thence by Abia Akers Land North forty one degrees West one hundred and twenty Perches to [a] Pine North fifty eight degrees West forty Perches to [a] Pine, North thirty nine degrees West thirty-two perches to a White oak and North seventy two degrees, West twenty eight perches to a Maple near the south branch of said Creek thence by the same north fifty six perches to a Post and North six degrees West one hundred and six perches crossing the Creek to a White oak thence north eighty degrees East eighteen perches to the place of Beginning. Containing two hundred and twenty five acres and twenty three perches and allowance of six pr. cent for Roads &c with the appurtenances (which said Tract was surveyed in Pursuance of a Warrant granted to the said Jonathan Buck dated the 28 October 1785) And Whereas the said Jonathan Buck & Zeruah his wife by their Deed Indented dated the tenth day of February one thousand seven hundred and eighty nine for the consideration therein mentioned did give grant bargain sell alien release & confirm unto the said Robert Akers his Heirs and assigns all that the before described Tract of Land containing two hundred and twenty five acres and twenty three Perches &c with every the Hereditaments and appurtenances thereunto belonging as in and by said recited Patent & Indenture Reference thereunto being had will more fully and at Large appear. Now This Indenture Witnesseth that the said Robert Akers, and Nancy his wife for and in consideration of the sum of thirty dollars lawful money of Pennsylvania to them in hand paid by the said Ephraim Akers the Receipt whereof is hereby acknowledged. Have granted bargained sold released and confirmed and by these Presents do grant bargain sell release and confirm unto the said Ephraim Akers his heirs and assigns all that the following bounded and described Plantation and Tract of Land being part of the before described tract of Land Beginning at a White oak one hundred and thirty four Perches along the beginning line of the before described Tract of land, thence south fifteen degrees East forty six perches to an apple tree south eighty three deg. East ninety Perches to a Post, North sixty two degrees West one hundred and sixteen Perches to the place of Beginning taking the Mill Races and Dams & no more containing eleven acres and ninety six Perches more or less of land and the usual allowance of six pr. cent for Roads &c. Together with all and singular the buildings Improvements hereditaments & appurtenances whatsoever to the said Tract of Eleven acres and ninety-six Perches more or less of land belonging or in anywise appertaining and the Reversions, & Remainders thereof and all the Estate right title interest property claim and demand whatsoever of them the said Robert Akers and Nancy his wife of in and to the same to have and to hold the said last described Tract of Land containing eleven acres and ninety six Perches more or less &c. & premises hereby granted with the appurtenances unto the said Ephraim Akers his heirs and assigns to the only proper use and behoof of the said Ephraim Akers his heirs and assigns forever. Under and subject to all taxes charges and assessments hereafter accruing thereon and the said Robert Akers and Nancy his wife their Executors, administrators & heirs they hereby bargained & sold Premises & every part & Parcel thereof with the appurtenances unto the said Ephraim Akers his heirs and assigns against them and their heirs Executors and administrators and against all and every other person & Persons whatsoever lawfully claiming or to claim the same shall and will warrant & forever defend by these Presents. In Witness whereof the said Parties to these Presents have hereunto interchangeably set their hands and seals the day and year first within Written. Be it remembered that the words, more or less in three places mentioned were interlined before signed.

In the Name of God Amen I Robert Akers of the Township of Providence and County of Bedford, being weak in body but sound in mind, memory and understanding, thanks be to Almighty God for the same Do make and ordain this my Last Will and Testament as follows ~ I desire, after my decease, that all my Estate be equally divided between my five sons, except my youngest son Wilson Lee, To him I give one sixth less than any of the rest, and at my death I will that all my personal Estate to be sold to the best advantage ~ and as soon as may be convenient, by my Executor, hereinafter named for the purpose above named ~ And I hereby appoint my beloved son J. Wesley Akers my Executor of this my last Will and Testament revoking all other Wills by me made ~ Witness my hand and seal the 29th day of October 1838.

Executor of the Last Will &c. of Robert Akers late of Providence Township deceased, and produced the account of his administration on the Estate of said deceased as passed by the Register of Bedford County, by which it appears there is a balance of sixteen hundred and sixty dollars, six and a half cents in the hands of said accountant, Int. from the 29th August 1840 And it appearing that notice had been given according to the Act of Assembly the same was Confirmed, and distribution awarded according to the will.
