During the Battle of New Orleans James Howey was among those Kentucky militiamen who were on detached service under the command of General Andrew Jackson. James Howey was an ensign, the lowest rank of non-commissioned officer.

Family tradition had him as a major. However it was much later, on January 21, 1828, that he was promoted and commissioned the major of the 3rd regiment of Kentucky militia vice Lt. Col. John Morris, who was likely the step-brother of his wife.

A message in writing was received from the Governor by Mr. Crittenden Secretary of state, which is as follows, viz.

Gentlemen of the Senate--Since the adjournment of the Legislature, in January 1831, the following officers have been commissioned until the end of your present session. I therefore nominate them for your advice and consent, to be commissioned to fill the offices respectively annexed to their names, viz:

32. James Howey, to be lieutenant colonel of the 23d [sic] regiment vice Jno. Morris, resigned.
33. Josiah Miller, to be major of the 3rd regiment vice J.Howey, if promoted.
