Joshua Saxon Will –
In the name of God – Amen.
I, Joshua Saxon of Claiborne County and Mississippi Territory being sick but in my perfect senses and memory and knowing it is appointed for all men once to die, I do constitute and appoint this my last will and testament in the words following (to wit) –
First it is my wish all my just and lawful should be paid.

-I give and bequeath unto my loving wife Medas Saxon my negro fellow James and his wife Hays, also my negro fellow George to serve in the raising of my two sons, young sons Orville and Melborne until the eldest is or might have arrived to the age of fourteen years old and then said George to be emancipated.

-I give unto my son Joshua Saxon Jun., my Negro fellow Moses.
-I give unto my son Samuel my negro fellow Harry.
-I give unto my daughter Charlotte Ingram, my negro girl Jane.
-I give unto my son Orville my negro girl Nancy.
-I give unto my son Melborne my negro girl Phebe.
-I give unto my daughter Lucinda Miller my negro woman Delie to serve as a slave until my son Orville is or might arrive to the age of fourteen years old and then to be emancipated.
-I give unto my daughter Clarrinda Anderson my negro boy Pompey.
-I give unto my daughter Nancy Anderson seventeen cents.
-I also give unto my daughter Malinda Terry the sum of seventeen cents.
-My stock of all kind shall remain on the plantation for the use of the widow and the two young children (to wit) Orville and Melborne.
-It is my desire that my negro woman Rachel should be sold and the proceeds of said sale to be divided equally between five of my children to wit: Joshua, Samuel, Charlotte, Orville and Melborne Saxon.
-I divide that two hundred fifty four dollars in the hands of Amaziah Ingram and the proceeds of the sale of seven bales of cotton now in the hands of Faulk and Shaifer merchants in Port Gibson or so much thereof as will carry into a grant the quarter section I now live on and the one adjoining for the use and benefit of my two sons Orville and Melborne.
-I also give unto my son Joshua Saxon twenty four dollars to be paid out of any surplus money arising from the estate.
-I also give unto my son Samuel forty dollars to be raised the same way.
-I do constitute and appoint Joshua Saxon, Jun., and Robert S Caldwell Executors and wife Medias Saxon Executrix of this my will and testament.
In testimony whereof I have hereunto set my hand and seal this 31st day of January in the year of Our Lord one thousand and eight hundred and seventeen.

NOTE: It is not proved that the Ambrose Joshua SAXON who married Nancy MILLS in Feb 1781 is the same as Joshua SAXON who married Lucy ALLEN and Medis INGRAM, but it seems highly likely.

One Ambrose Joshua SAXON married Nancy MILLS in 1781--it seems logical to assume that this might be a son of Charles and Judith (SMITH) SAXON, named for her father, if he was Ambrose Joshua SMITH.

REV. WAR: From "Patriots of South Carolina in the American Revolution" by Bobby Gilmer Moss, 1983, Genealogical Publishing Co., pp.847. "Issued the 7th of April 1785, to Joshua Saxon for 33 pounds, 3 shillings and six pence, three farthings sterling for 154 days Militia Duty in 1780, and for a horse lost in service." He served as a wagoneer in the Little River Regiment under Danube McQuin and Colonel James Williams during 1780. Audited Account 6799; N362 and Z591.

Joshua Sexton, 121--/11012. Meaning he had 3 sons, and 2 daughters, plus his wife and 2 other females 45 and over in age and then 10 slaves. Living nearby and on the same census page are Elisha Duvall and Moses Ingram. Elisha Duvall named in the estate settlement of a John Saxon in 1814. Don't know where this John Saxon fits into the family yet. There is a John Saxon in 1790 also in Laurens District, Sc. living near Joshua Saxon.

CENSUS: The Official & Statistical Register of the State of Mississippi shows that in 1816, when Mississippi was still a territory, there were about 295 families living in Claiborne County. Heads of the families listed included: Joshua Saxon and Moses Shelby pp.28. 'Claiborne County, Mississippi - The Promised Land' by Katy McCaleb Headley. 1976.

DEATH: Joshua Saxon Junior and Robert S. Caldwell provided in court a paper purporting to be the last Will and Testament of Joshua Saxon Senior devised - whereupon the same was admitted to probate by Moses Shelby and John F. McCaa witness thereto.
Advised that the same Will of the said Joshua Saxon Senior dec'd be issued and recorded.
Ordered that Letters Testamentary of said Will upon that Joshua Saxon and Robert Caldwell Executors therein ordered upon their taking the usual oath used in giving bond in the sum of eight thousand dollars.
Ordered that Moses Shelby and Stephen Miller be appraised of a d... with said executors.
Said Joshua Saxon and Robert Caldwell took the usual oath of executors and executed their bond in $8,000 with the said Moses Shelby and Stephen Miller thru securities.
Ordered that the said Executors of the Last Will and Testament of Joshua Saxon dec'd return into this court within three calendar months an inventory and appraisal of said estate.
