Ben Burgess married Mary Ellen Walters on 5 January 1862 in Collin County, Texas. There were four children born to this union - James Burgess, Sarah Ellen Burgess, John William Burgess, Mary Elizabeth Burgess. His wife preceded him in death in 1869 in Collin County, Texas. She is buried near McKinney.

Ben Burgess married his wife's older sister, Sarah Ellen Walters on 12 September 1869 in Collin County, Texas. There were five children born to this union.

Ben Burgess came to Texas as a young man with a cousin, Josh West in the 1850s. Mr. Burgess joined the Texas Rangers and was discharged to join John Bell Hood Brigade to fight in Civil War. He settled in Collin County near McKinney in 1865. For most of the 1870s, Ben Burgess spent in Collin County farming. He bought land in Stephens and Young Counties from bankrupt farmers and left Collin county in 1878. Benjamin Burgess farmed and ranched in Young County for 29 years. He kept buying up land until he amassed 5,000 acres. Benjamin raised cotton, corn, wheat, tobacco, and all the family food. He bred livestock including horses, cattle and hogs.
