He was the youngest son of Joshua Counts (born 1801)and Martha Kiser. He married Martha M. Finney on November 1, 1854, and they had three little girls. Joshua died of an unknown disease just two months before the birth of their third daughter. His wife Martha died the following year, and her parents raised their children.
