He was born in Virginia City, Montana on February 15, 1885. He graduated with a law degree from Stanford University, then after graduation, he moved to Butte, Montana.
He married Kathryn M. Leonard on April 17, 1910, and they had two sons.
Judge Bennett was appointed to the 5th Judicial
District by Governor Joseph M. Dixon in 1921 after the death of Judge William A. Clark, but was defeated by Henry Rodgers in 1937. He was reelected in 1942 and resigned as a district judge on July 1, 1952. He died in Helena, Montana on November 16, 1967, at age 82.
