Residing in Robeson County, North Carolina at the time of enlistment. Enlisted on March 10, 1863 at Charleston, South Carolina as a Private in the 31st North Carolina Infantry, Company A at the age of 35. POW on July 1, 1864 at Cold Harbor, Virginia. Confined on June 11, 1864 at Point Lookout, Maryland. Transferred on July 12, 1864 to Elmira New York. Killed in a railroad accident near Shohola, Pennsylvania as a POW.

He was survived by his wife, Sarah Ann Gibson, and two young sons, Thomas Baxter Baxley and Allen Lane Baxley
