Mary Weber was born ca. 1732 and died sometime between 25 Jul 1797, when she wrote her will, and 09 Sep 1797, when the will was proved, around age 65.

She married Peter Van Fossen ca. 1753. He was the son of Conrad Van Fossen and Ann Bon. He was born ca. 1730 and died prior to Feb 22, 1791.

Peter and Mary moved to Oxford Township, Chester County, Pennsylvania in 1785, where Peter appeared on tax records as both Peter Van Fossen and Peter Fox. He Americanized his Dutch Van Fossen name, which is the Dutch word for fox.

Mary lived on the farm with her sons Benjamin and John near Oxford, Chester County, Pennsylvania until her death.

Mary's will listed the children she had with Peter Van Fossen. It is on file at West Chester, Chester County, Pennsylvania:

"The office Michael Hannum Regr.

"Mary Foxes Will

"In the name of God amen. I Mary Fox upper oxford Chester County being weak in body but of sound memoray bless be God do this 25th day of July 1797. We Make and publish this my last will and testament in manner and form following that is to Say first of all To order that all my Just debts & funeral charges be paid.

"I give to my son John my black mare and her horse coalt and also my two year old Black filley and his choice of one of the cows one ewe & three lambs with all the hoggs.

"to my son William the sorrel horse

"and the remainder of all my estate I order to be sold by my Executors hereby after named in order to pay my Just debts and the remainder of said cash to go to my son William with the deduction of two shillings and sixpence for my daughter Catherine and also my sons Jacob, Benjamin & Nancy each of them two shillings & sixpence to be paid when conveniabity got.

"If my son William sould die before he comes to age and leave neither wife nor Child his share is to revert to three parts to be divided between my son John and my two grandchildren Abraham and Henry Foust.

"It is my will and I do order that John Hott and Jacob Sepber whom I likewise constitute make and ordain my only and sole Executors of this my last will and testament and I hereby utterly disallow revoke and disannul all and every other former testament wills Legacies & Executors by me in any wise Named before this time ratifying and confirming this and no other to be my last will and testament.

"In presence of us William Dickey, R. Smith, James Dickey, West Chester September the 9th 1797 then personally appeared William Dickey and James Dickey and on their oath according to law doth depose declare and say that the were present and did see and here Mary Fox the testator within named sign seal and publish pronounce and declare this Instrument of writing to be her last will and testament and that at the same time she appeared to be of a sound mind and memory to the best of their understandings.

"Sworn Before John Hannum Rjr. Be it remembered that on the ninth day of Sept 1797 The last will & Testament of Mary Fox deceased was proved in due form of law and letters Testamentary were granted to John Hoot and James Sepber, Executors in the said Testament named they haveing been duly sworn well and truly to administer and bring in an Inventory of the deceaseds estate into the Registers Office for Chester County on or before the ninth day of October next and to Settle the accounts of their administration within a year of when legally required.

"Given under My hand and Seal of Said Office Jno. Hannum Regr."

Another document in the county records reads:

"NO 4598 The administration Accpt. Of Mary Fox-fossen [fossen crossed out], Deceased, of Oxford Township Chester County Filed Febry 18th 1800

"The Accompt of John Hoot and Jacob Lafevour of Oxford Township Chester County and State of Pennsylvania Executors of all and singular the Goods and Chattles (Rights and Credits) of Mary Van fossen of Oxford Township aforesaid deceased as well of and for such & so much of the same Goods & Chattles as came to their Hands, as of & for their payments & Disbursements out of the same." Amounts in pounds, shillings, and pence were listed, along with the payees, to include John Fox, Benjm. Vanfossen, and John Vanfossen's legacy.
