Son of James F. & Rosanna (Hinkle) Magee, in 1858 he completed a math course at Georgetown College and joined the U.S. Costal Survey. In 1860, he was a teacher and businessman living in Wrightsville, York County, and stood 5' 10" tall with dark hair and brown eyes.

A Civil War veteran, he enlisted in Wrightsville August 17, 1861, and mustered into federal service at Harrisburg October 24 as a sergeant (contrary to what his monument says) with Co. I, 76th Pennsylvania Infantry. He received promotion to 2nd lieutenant August 8, 1862, to 1st lieutenant May 16, 1863, and ultimately to captain on June 12, 1864. He was often sent on special assignments such as recruiting. aide de camp, and served as division ordnance officer. As one man put it, he was "mostly on staff duty away from his company." He received an honorable discharge November 28, 1864, and returned to Wrightsville where he captained the Wrightsville Grays National Guard through the end of the war.

He married Martha H. Smith July 29, 1868, in Wrightsville and fathered Robert S. (b. 08/29/69) and Helen M. (b. 08/06/72). He assumed the position of superintendent of the Soldier's Orphans Industrial School in Scotland, Franklin County, and died there. He maintained a 230 acre farm in Hellam Township, York County, that was sold at auction after his death, and he left $8,000 in life insurance, but he owed David Detwiler $6,000.
