Eugene D. Aiken of Rochester yesterday was declared to be in contempt of court for failing to pay alimony to Mrs. Henrietta A. Aiken. He is in arrears nearly $3,000 on his payments.

Eugene Aiken of Rochester, formerly of Le Roy Owed Alimony.

Eugene D. Aiken of Rochester and formerly o f Le Roy, was last Saturday given his choice of serving a term of six months in the Monroe county jail or paying his former wife, Henrietta Tucker Aiken, $3,000 alimony. Mr. Aiken was arrested on Friday night on contempt of court for not having paid the alimony which was awarded his wife in 1907, being $6 a week and which has been accumulating since that time.

Mr. and Mrs. Aiken were married in Le Boy about 18 years ago. By serving six mouths in jail the judgement will be wiped, out and in the future his former wife can not take any action against him to collect.
