Will Transcript
In the Name of God Amen, I Walter Newman of the County of Shenandoah & State of Virginia being of sound mind and memory, and considering the uncertainty of this mortal life, do make and publish this my last Will and Testament, in manner & form following, that is to say, I first will and devise that all my Just Debts and funeral expenses shall be paid out of my Personal estate,
I give and bequeath unto my beloved wife Catharine Newman, two Feather beds, bed-steads, Furniture to be chosen by her, out of any in my leave, she is also to have the priviledge of living in the Houses where we now live and occupying and enjoying the part that her & myself, now Occupy during here life, I also give and bequeath to her the use and service of the negroe Woman Lucy and her son Peter, during her life, I also direct that one hundred Dollars Eash be paid to her after my death which she is to dispose of as she shall choose. She is also to retain for her use such other part of the Household and Kitchen furniture as she may deem necessary for Convenience. I also direct that she have two cows the choice of any I may have at the time of my death, which are to be kept and pastured for her by my son John Newman.
I also direct that my son John Newman provide her in all kinds of provisions & fire wood, in the same manner as he now furnishes myself.
I direct that my son John Newman do annually pay to her one thirt part of the nett profits made of the Plantations in the same manner as her is to pay them to me, during my life by our agreement entered into between him and myself.
I give and bequeath unto my son Jonathan Newman, one hundred and twenty pounds to be paid him by my Executors after my death, this sum he is to have in addition to what I have already given him.
I give and bequeath to my Daughter Mary Moffett wife of Daniel Moffett, one hundred pounds to be paid her after my death in addition to what she has already received.
I give and bequeath unto my Daughter Elizabeth Hoy wife of Zachariah Hoy one hundred pounds, to be paid her after my death, in addition to the sum she has already received.
I give and bequeath unto my Daughter Catherine wife of Bernard Peal one hundred pounds in addition to what I have already given her.
I give and bequeath unto my son Samuel Newman one hundred pounds in addition to what I have already given him.
I Give and Devise unto my son John Newman and his Heirs all the land which I own in the County of Shenandoah Consisting of six small tracts lying together and adjoining each other and Containing about three hundred and ninety acres and being the same lands which I convenanted to devise to him by my agreement entered into with him and bearing ever date with this Will, this land I have valued to him at Twelve hundred pounds, three hundred & fifty pounds of which he has already paid as mentioned in said Agreement, the balance of eight hundred and forty five Pounds he is to pay to my other Heirs, should he not pay the same to me in my lifetime, But whatever sums he may pay me in my lifetime, towards the £845, he is to have Credit for, after my death, and only pay the ballance remaining unpaid after my death ~ he is also to provide for his mother in the manner mentioned in the first part of this will, which relates to her, and he is also annually during her life to pay her the one third part of the nett profits of the said plantation and lands thus devised to him ~ and after her death the same is then to belong to him & his Heirs forever.
I give and bequeath unto my daughter Ann Newman one hundred pounds in addition to the sums which she may receive to make her equal to her other sisters, she as yet having received nothing.
I give and bequeath unto my son Walter Newman Twenty five pounds in addition to the sums I have already given him.
I Give and bequeath unto my Daughter Lydia Hupp wife of Benjamin Hupp one hundred pounds in addition to the sums already given her.
I Give and bequeath unto my Daughter Margaret Ruffner wife of Martin Ruffner dec'd one hundred pounds in addition to the sums already given her.
Should I pay to any of my above named children (with the exception of Ann) any sum or sums of money or direct the same to be paid to any of them after the day of the date of this will, then the same is be Credited in part of the foregoing Legacies devised to each of them, and they are only to receive the balance of the foregoing Legacies from my Executor after my death - which may remain unpaid in my lifetime ~
After the payment of the above Legacies which take up all the money coming from my son John for the land I have devised to him ~ I will & direct that all the rest and residue of my personal estate, of whatsoever kind or nature together with the Negro woman Lucy & her son Peter and any future increase she may have be sold my Personal estate (except the negroes) immediately after my death, and the Negroes immediately after the death of my wife, and all the money arising from such sales to be equally divided amongst all my ten children, and should any of my children die before me, or before the death of my wife, then and in that case the Heirs of him or her so deceased is to inherit the share or portion devised to his her or their for their or mother, my will being that if any of my children should happen to die before me the Heirs of him or her so dying are to have all which I have devised to their father or mother in as full and ample a manner as their father or Mother would have had the same, had they been alive at the time of my death ~
And Lastly I do hereby Constitute my son John Newman and my son Samuel Newman Executors of this my last Will and Testament, Hereby revoking all former & other Wills made by me, and declaring this, and this only as and for my last Will & Testament.
In Witness whereof I have hereunto set my hand & seal this ninth day of December in the year of our Lord one thousand eight hundred & twelve.

At a Court held for the County of Shenandoah on Monday the 7th day of August 1815.
The last Will and Testament of Walter Newman deceased was produced in Court and was proved by the Affirmations of Joseph Strickler and Jacob Hershberger and ordered to be recorded. And upon the motion of John Newman & Samuel Newman the Executors therein named who made Oath and entered into Bond together with Joseph Moore their Security in the sum of Ten thousand Dollars, Conditioned as the law directs, a Certificate for obtaining a probate thereof in due form is granted them.
