Tommy's horse then fell over the first horse and his horse rolled over him and stepped on his back. He was unconscious. Dr. Glessner who was attending the race took Tommy to his home where he later died of his injuries. His wife Hannah was in the stands to witness the fall.

During a horse race in Aspen coming into the final stretch the first horse cut in front of the second horse which made the second horse fall. A third horse carrying Tommy fell over the second horse. His horse rolled over him and stepped on him badly damaging his back and he fell unconscious. This happened in front of the stands so it was witnessed by everyone including Tommy's wife Hannah. A doctor who was at the race took him to his home where he briefly regained consciousness and kept him sedated on morphine. He died of his injuries a short time later. He was not buried in any cemetery in Aspen, Glenwood or Eagle. It is believed he was buried on their property in Aspen. His wife Hannah later moved with her children to Eagle where her parents, brothers and sisters lived.
