Pineville, Ky., - Oct. 10 - On Phillips Fork Creek, in Leslie county, twenty miles from here, Ephraim Helton, an old soldier, has dug his own grave in a cave fifty feet from the outer surface by tentering and cutting the vault in a rock inside the cave. He has measured it with his own body and has finished it with a perfect fit. He has also cut his own tombstone from a rock and has placed it above his grave.

He says he will soon commence to make his own coffin and will buy his burial clothes, so that no one will be at any trouble in putting him away. Helton is about 63 and a prosperous farmer.

Ephraim HELTON, who was tried last week at Hyden and given one year in the pen, was 75 years old. He was charged with being and accomplice in the shooting of Carlo HELTON.

An unusal case, tried at the same term of court, was that of the commonwealth of Kentucky agt. Eph Helton and his son John, charged with conspiracy to murder Carlo Helton, Eph's brother. Eph is seventy-one years old. The Heltons were good friends until a few years ago, when a feud arose in which the Heltons, Caldwells and Howards were opponents. A store belonging to E. J. Howard was burned, and he accused young Jonah Helton, Carlo Helton's son, of being the incendiary. John and Jonah Helton then had a quarrel, and John declared that he and Jonah had burned Carlo Helton's store house. Jonah Helton was tried on that charge, but was adquitted because of no evidence against him.

Shortly afterward John Helton walked in the yard at his home one night. A shot was fired from the bushes nearby, and John Helton was carried into his home badly wounded with a ball through his lungs. A. D. Knuckles was charged with the crime and sent to the penitentiary. It later transpired that Carlo Helton, uncle of Knuckles and John Helton had employed Knuckles to do the shooting. The Eph Helton arose in his wrath and swore vengeance on his brother Carlo and Jonah. Eph employed Ben Caldwell and John Collins to waylay and kill Carlo. The would-be assassins hid themselves in the bushes, and when Carlo came out of the house and was gathering apples nearby Collins and Caldwell fired on him with their Winchesters, badly wounding Carlo. The two assassins are now in the penitentiary. Seventy-one-year-old Eph Helton was tried and sentenced to the penitentiary, as was his son John. John had one sentence to serve for burning a house belonging to Mat Belcher, a friend of the family.

With such enviroments, it is little wonder that the mountaineers of Kentucky are mostly engaged in feuds.
