His wife was Sarah Emma Passwaters. Sarah's parents were Frank Passwaters and Hester J Workman.

The 1910 Census finds Emory, wife Sarah and 3 month old daughter Myrtle in Kent Co, DE where he was a general farmer. Daughter Myrtle marries a Messick.

Emory's WWI Draft of 1917 shows he had a wife and 4 children.

In 1920, he is still a farmer in Kent Co, DE, with wife Sarah and the following children: Myrtle M Legates 10, Annie E Legates 8, Elmer E Legates 5, Frank J Legates 3[3 8/12] and Russell C Legates 1[1 6/12].

In 1930, on the Census, Emory is listed as widowed with the following children in his home: Annie Legates 17, Elmer Legates 16, Frank Legates 15, and Russie Legates 12.

His WWII Draft Card shows a sister Hattie Chism of Chester, PA as the person who would always know his address. No mention of a wife.

NOTES: There were additional children for Emory per the 1975 obituary of his son Frank J Legates: Oscar, Sarah and Katherine. The 3 children were found in the Murphy School (a group foster home) in Dover, Delaware on the 1930 Census.

In 1940, she is still at the foster school. In 1973 she was married to George Hobbs and in Stanton and in 1975 she resided in Newport. When her brother Oscar died in 1993, she was residing in Wilmington, DE.
