Will of Leonard Smith 1819 Rowan County, NC

In the Name of God Amen, I Leonard Smith Senior of the County of Rowan and State of North Carolina Being now of perfect mind and memory and knowing that it is appointed for All men to dy and callin g to mind the same do make and ordain this my Last Will and Testament that is to say principally and first of all , I give and recommend my Soul into the hands of Almighty God that gave it hoping a t the morning of resurrection It will receive protection under the kind merits of our Blessed Redeemer , and my body to the dust to be resurrected In a decent manner at the discretion of my executo rs & to my worldly Estate that it has best pleased God to bless me with , I will and dispose of in manner and form following (First ) I will and bequeath that all my just debts be paid as speedily a s possible
2nd I Will and bequeath to my beloved wife Margaret the dwelling house wherein I now live during her continuance as my widow and ten acres of land to tend during the same term of time and seventee n bushels of grain , half corn and half wheat which said grain is to be paid to my wife Margaret by four sons ( David, Jacob, Leonard , and George ) Each to pay an equal share of said grain to my wif e Margaret during her continuance as my widow each and every year and I also I will to my wife Margaret one brown mare named horn and one heifer her choice of my stock , two hogs, one sheep, her ch oice of my stock six plates and one dish , six spoons, six knifes , and forks pot , one oven , three chairs, one bed, and the necessary furniture to said bed , one plough axe and hoe and one pai r of plough ______ her riding saddle and bridle and also one negro girl named Hannah during her continuance as my widow then the said negro girl Hannah thereafter to be disposed of as hereafter ment ioned .
3rd I Will and bequeath to my eldest son Jacob Smith the plantation wherein he now lives and one hundred acres that I entered joining to said tract and one hundred acres out of a three hundred acr e tract lying in Buck Branch .
4th I Will and bequeath to my second son David Smith the plantation wherein he now lives
5th I Will and bequeath to my third son Leonard Smith the lands which I have deeded to him and one hundred acres more out of a three hundred acre tract lying on Buck Branch.
6th I Will and bequeath to my fourth son George Smith the plantation wherein I now live and ninety eight acres that _____ land tract , and one hundred acres out of a three hundred acre tract lyin g on Buck Branch and to have the use of half of the meadow that I have willed to my son David Smith six years after my death to cut and make use of as his own .
7th I Will and bequeath to my eldest daughter Catherine Kinny Five shillings and no more of my estate .
8th I Will and bequeath that all my property personal real, and moveable not above willed and disposed of to be put to sale and twelve months of credit and the amount of said sales to be divide d as herein after named to wit My five daughters Peggy Cross wife of David Cross , Susanna Cross wife of George Cross , Elizabeth Lane wife of Jesse Lane and the children of Mary Fry deceased an d the children and the children of Nancy Homes of wife of Jesse Homes each of the above named legatees to have one hundred and fifty dollars . that ( is to say ) Peggy one hundred and fifty dollar s , Susanna one hundred and fifty dollars , Elizabeth one hundred and fifty dollars , and the children of Mary Fry deceased one hundred and fifty dollars and the children of Nancy my youngest daughte r one hundred and fifty dollars and the balance of money from said Sales will and bequeath to be equally divided between my children herein named (to wit ) Jacob Smith , David Smith, Leonard Smith , George Smith, Margaret Cross, and the children of Mary Fry deceased to draw in equal shares as and legatees Susanna Cross, Elizabeth Lane, and the children of Nancy Homes my daughter as one legate e also I Will and bequeath to Nancy Homes five shillings and no more of my estate .

I Will and bequeath that the negroe girl named Hannah that I have left to my wife Margaret at her death or intermarriage should such an event as marriage take place and all the rest of the property th at she may have at that time to be sold and equally divided as the balance of sales are to be divided at or after my death

I Constitute and appoint my two sons Jacob Smith and George Smith as my sole executors to this my Last Will and Testament In witness whereof I have herein to set my hand and seal this the First d ay of June in the year of our Lord Eighteen Hundred and Eighteen
