Benjamin was a Mystery and we believe he was buried close to his wife Mary Seleta Jenkins Smith but there is no longer evidence because of burned records
We now know Benjamin was married twice. The biography below includes some info on his first and second family.

Benjamin Franklin Smith is a mystery. We think he came to the Neshoba county and to Philadelphia. Mississippi one day
riding a black horse. He supposed to have lived in North Carolina before he came to Mississippi.

It is said that he got into a fight in North Carolina and accidentally killed a man. According to the legend. the local law enforcement told Benjamin to leave the state or they would have to arrest him. Great Grandfather Benjamin died when he was in his sixties.

His son, John J. Smith said he was between four and seven years old when Benjamin died. On his death bed. Benjamin confessed to his children about killing the man in North Carolina and said he hoped the Lord had forgiven him. That one act must have tortured him all his life.

It is said that he never mentioned his family in North
Carolina. It is also said that no one visited him and he never visited anyone. No bounty hunter ever came after him.

His past will remain a mystery.

After the presumed death of his 1st wife, Mary AE (maiden name unknown) he then married 2nd Mary Seleto/Seleta JENKINS who was born about 1832 She died about 1910. Aunt Emma Smith Crocker stated she was about 12 years old when Gr Grandma died. Using this information, Aunt Emma's birth date is the 25th of March 1898. That would put Gr Grandma's death approximately 1910.

"Mary Seleta Jenkins is said to be part Choctaw, however some say this is not true because her children couldn't receive government payment for Indian Lands. According to my dad, John J. Smith, her Indian name meant 'Little Leaf.

She was about fourteen or fifteen years old when she married Benjamin. Mary was of slim build and had long, straight black hair and was only about five feet tall. Benjamin Franklin SMITH and Mary Seleta JENKINS had the following children:
