T. D. Smith, an administrator of the H. L. Brough estate has filed suit against Bart Everman for 15000 claimed due the estate because of the death of H. L. Brough. a little over a year ago, Brough, a tinner by trade, was called to the Bart Everman home north of the city to repair the tank to the acetylene lighting system. The petition claims that the everman assured Brough that there was no gas left in the tank and that the repair was to be made in the form of a patch over a hole which had been worn in the tank in question. Brough, in compliance with the request, entered the cellar in which the tank was and lighting a match caused the explosion which caused his death. the petition claimed that Brough inquired of the Evermans whether or not there was any calcium carbide gas in the tank at the time and was told positively that there was none. The petition further states that this negligence on the part of the defendants was the cause of his death and for which they ask $15,000. The attorneys for the plantiff are Parsons & Miller of Des Moines.
