The son of Dr. Nelson Samuel Waller and Mary Hampton DeJarnette Waller received his early education from John Pettus of the University of Virginia. In 1864, he became a cadet at Virginia Military Institute. On 15 May 1864, he participated in the Battle of New Market as a private in Company C. After the war, he read law under Judge Welch of Caroline County and was admitted to the bar. He served as Spotsylvania's Assistant Treasurer as well as her Commonwealth Attorney. In 1880, he was elected judge of the county court. He was a large property owner and a prominent member of Waller's Baptist Church. His first wife was Constance Gardner Cazenove, whom he married in 1883. She died in 1885 without children. Judge Waller married Kate Perkins Dew in 1902. They produced Nannie and Robert Emmett Jr.
