When James' will was probated on November 9, 1863 there was an interesting clause in the will.

"The ground now used as a burying ground for the dead on or near the southeast corner of my farm and near the road be kept for that purpose and no other as long as grass grows and water runs and not to be conveyed to any person and request that sew reserve as a burying ground be 32 ft. north and south by 30 ft. east and west and also reserve a road or path 6 ft. wide from highway to the said burying ground to be reserved the same as the burying ground.
