George W. Bowen is said to have built and opened the first grocery store
in Moravia, on the corner of Church and Main Streets, in 1821.[419] He sold
half an acre of land in Lot 83 in Moravia in April 1833, at about the same time
his father was disposing of his land, but he bought a larger acreage in

George W. Bowen´s household in 1850 was ''Adoiram G. J. Marsh,´´ age 30, born New York.
The name of Electa´s first husband was discovered in the following way. George´s will, as we
shall see, provided for his wife´s daughter, Lucy Ann Baker, probably the Lucy A. Bowen, 15,
born Pennsylvania, who was in his household in 1850; she was still in Moravia in 1870, age 34,
wife of William T. Baker (1870 U.S. Census, Moravia, Cayuga County, New York, roll 911, p.
509A). In 1880 the Bakers were living in Michigan, and she was recorded as age 44, born
Pennsylvania (1880 U.S. Census, Cato, Montcalm County, Michigan, roll 596, p. 60D). Lucy Ann
Baker died in Lakeview, Montcalm County, 7 October 1902, age 67, born Pennsylvania, daughter
of William Hall and Electa ''March´´ (Michigan Deaths and Burials, 1800-1995, online at
FamilySearch.org).

Moravia´s Lot 43 the next year.[420] The 1850 census of Moravia counted
George W. Bowen, 52, a farmer with property worth $4,050, and [his second
wife] Electa A., 35, both born N.Y., with children George, 16, Lucy A., 15,
Mary J., 13, Louisa A., 7, William M., 5, and Leander P., 3.[421] With his
siblings either dead or living out of state, George W. Bowen was left as head
of the family in Moravia. He handled his father´s care, if somewhat
controversially, and was the executor of his father´s second will. By 1860 he
was a very prosperous farmer with real estate worth $8,600 and personal estate
worth $1,250.[422] The 1867-1868 gazetteer of Cayuga County listed his
holdings as 137½ acres in Moravia.[423]
George made his own will on 16 July 1869, at the age of ''seventy-one and
upwards,´´ and it was proved 17 Sept. 1875.[424] He ordered that a lot be
purchased in Davidson Cemetery and that ''suitable tombstones´´ be bought to
mark the graves of his father, mother, and children, as well as for his wife in
the future. He named his six living children: Bassett J. Bowen, Orson Bowen,
Leander A. Bowen, George W. Bowen, Jr., William M. Bowen, and Louisa
Davenport-and children of his deceased daughters Eunice A. Pond and Mary
Ann Cook. All were to share equally after the death of his wife Electa. He also
left a legacy of no more than $100 to his wife´s daughter, Lucy Ann Baker.
The provision for his widow was prudent. In 1880 Electa Bowen, 68, was
head of a household in Moravia of herself and two granddaughters.[425] From
the mid-1880s she was being boarded and cared for by others. Hundreds of
receipts in surrogate court records detail the minutest aspects of her daily life
to her death in 1890, including charges for opium, belladonna, camphor, oil of
cloves, and other sickroom supplies.[426]

The Auburn Daily Advertiser Saturday Evening January 27, 1855 (excerpt from the William Bowen will contest):

"It was claimed by the counsel resisting the Will that the legal Domicile of the Testator was in Rhode Island, and that the Surrogate of Cayuga County had no jurisdiction to admit this Will to Probate. It is averred in the allegations that the Testator was unlawfully kidnapped and carried away from Rhode Island and brought to this State by his Son, GEORGE W. BOWEN, against the assent and express direction of his Guardian. On this subject of Domicile the rule of law, I apprehend, is very clear and explicit. The declarations and intentions of the Party, accompanied by acts decide the question of his Domicile. It is in evidence in this case that the Testator expressed a wish to his Son, GEORGE to come home with him from Rhode Island. George asked him if he would go of his own free will and accord, and the Testator replied that he would. There is no evidence of force or other undue influence on the part of GEORGE in respect to the Testator's coming to this County. After his arrival here we have his declaration to Dr. HORTON, BARTON SLADE AND PELEO SLADE that he intended to make his home with GEORGE. He resided with GEORGE until his death. I cannot coincide with the counsel in the doctrine that the Guardian had a legal right to direct the place of the Testator's residence or to prohibit his coming away from Rhode Island. One of the reasons urged in the application for a Guardian was that the Testator needed some person to "assist" him in the management of his business. This is a virtual admission of some capacity for business in the Testator; and so long as the capacity which this case shows he possessed, was retained by him, the he and not the Guardian, had the right to determine the question of his residence or Domicile.-The case cited by the counsel on this question is not in point. That was a case where the Party had not changed his Domicile. He resided in New Jersey, and kept up an establishment there. He went to New York City to be under the care of a Physician where he remained two years and died. It was held that his Domicile was in New Jersey, that he was absent temporarily and for a specific purpose.-(1 Bradford 69, &c)-I must therefore overrule this objection, and decide that the jurisdiction in the admission of the Will to Probate was rightly taken."

"No fraud or duress is shown on the part of GEORGE in procuring the Will. The Testator lived with him, and it may be that GEORGE endeavored to induce him to make him his principal legatee and Devisee, although there is no evidence in the case that such was the fact. GEORGE may have shown a lack of proper feeling toward the other heirs, but that is a question that does not legitimately belong here. A person has a right, by fair argument, or persuasion, to induce another to make a Will in his favor.-(3 Denio, 37.) So long as there is no fraud or duress and the Testator has the necessary capacity the Will cannot be avoided, although a particular heir or other person is made the Legatee and Devisee of the principal share of the Estate, to the exclusion of other persons equally, if not more deserving, of the Testator's bounty. This rule results in great injustice to many instances, but it is the law of the land and is thought to be ????? ????? ????? [grounded in sound?] reason."

The Auburn Daily Advertiser Saturday Evening January 27, 1855 (excerpt from the William Bowen will contest):

"It was claimed by the counsel resisting the Will that the legal Domicile of the Testator was in Rhode Island, and that the Surrogate of Cayuga County had no jurisdiction to admit this Will to Probate. It is averred in the allegations that the Testator was unlawfully kidnapped and carried away from Rhode Island and brought to this State by his Son, GEORGE W. BOWEN, against the assent and express direction of his Guardian. On this subject of Domicile the rule of law, I apprehend, is very clear and explicit. The declarations and intentions of the Party, accompanied by acts decide the question of his Domicile. It is in evidence in this case that the Testator expressed a wish to his Son, GEORGE to come home with him from Rhode Island. George asked him if he would go of his own free will and accord, and the Testator replied that he would. There is no evidence of force or other undue influence on the part of GEORGE in respect to the Testator's coming to this County. After his arrival here we have his declaration to Dr. HORTON, BARTON SLADE AND PELEO SLADE that he intended to make his home with GEORGE. He resided with GEORGE until his death. I cannot coincide with the counsel in the doctrine that the Guardian had a legal right to direct the place of the Testator's residence or to prohibit his coming away from Rhode Island. One of the reasons urged in the application for a Guardian was that the Testator needed some person to "assist" him in the management of his business. This is a virtual admission of some capacity for business in the Testator; and so long as the capacity which this case shows he possessed, was retained by him, the he and not the Guardian, had the right to determine the question of his residence or Domicile.-The case cited by the counsel on this question is not in point. That was a case where the Party had not changed his Domicile. He resided in New Jersey, and kept up an establishment there. He went to New York City to be under the care of a Physician where he remained two years and died. It was held that his Domicile was in New Jersey, that he was absent temporarily and for a specific purpose.-(1 Bradford 69, &c)-I must therefore overrule this objection, and decide that the jurisdiction in the admission of the Will to Probate was rightly taken."

"No fraud or duress is shown on the part of GEORGE in procuring the Will. The Testator lived with him, and it may be that GEORGE endeavored to induce him to make him his principal legatee and Devisee, although there is no evidence in the case that such was the fact. GEORGE may have shown a lack of proper feeling toward the other heirs, but that is a question that does not legitimately belong here. A person has a right, by fair argument, or persuasion, to induce another to make a Will in his favor.-(3 Denio, 37.) So long as there is no fraud or duress and the Testator has the necessary capacity the Will cannot be avoided, although a particular heir or other person is made the Legatee and Devisee of the principal share of the Estate, to the exclusion of other persons equally, if not more deserving, of the Testator's bounty. This rule results in great injustice to many instances, but it is the law of the land and is thought to be ????? ????? ????? [grounded in sound?] reason."
