"In 1700 John and wife Rebecca [Spencer] conveyed land to his brother James; On 14 Aug 1705 John and his brother, Nathaniel were made joint guardians of four children of their deceased brother Thomas, and John remained guardian after the death of Nathaniel in 1710. The latter's will remembered John's children among his many heirs. John deeded various tracts of land to his sons and to his son-in-law John Mitchell, which would indicate the previous death of his wife. On 7 Dec. 1727, he made a deed of gift to his son Benjamin, part of the home lot with thehouse, barn and orchards, reserving life use to himself and mentioning no wife, indicating that he was then a widower and intended to live with Benjamin for the rest of his life.

Administration on his estate was granted, 22 Sept. 1736, to his son John, who gave bond with Bartholomew Foster of Wallingford. Four days later a mutual distribution was made by the heirs John Ackly (called eldest son), Benjamin Ackly (called second son), Nathaniel Ackley, Timothy foster and wife Thankful, John Mitchel and wife Rebeckah, Sarah Ackly and mary Ackly. " (Ibid)
