He resigned May 11,1863. On Jun 23,1863,he became Colonel of the 28th PA Emergency Troops. Mustered out Jul 28,1863. Appointed to Governor Andrew G. Curtin's Staff with the rank of Colonel. He served as State Military Agent for the Southwest with headquarters at Nashville,TN, from May 27,1864 to Apr 1,1866. He remained in Nashville where he died in 1909.
