In the name of God men, I Davis Burgess of the county of Henry being of sound mind and wishing to make a disposition of my worldly goods do make this my last will and testament hereby revoking all others. Whereas I have heretofore given to some of my children a part of my estate by way of advancement to wit to my daughter Elizabeth Hefflefinger I have given a bed and a sow and pigs a cow half, a side saddle worth about thirty dollars to my daughter Sally Harrison a side saddle and one feather bed and 1 cow & yearling mounting to forty three dollars, to my daughter Polly Potts one feather bed mounting to fourteen dollars, to my son Hewlett Burgess I have given one bed one cow and calf one sow & pigs, one horse amounting seventy nine dollars also one tract of land containing one hundred acres worth two hundred dollars in all mounting to two hundred and seventy nine. To my son Thomas I have given a horse mounting to thirty dollars. To my wife Lucy Burgess I give during her life my tract of land lying on the south aide of Smiths river containing one hundred & forty acres, one negro man named Tilman two apprentices which were bound to me, David Man & Reuben Ban, one feather bed & furniture whichever she may choose horses also all my stock of cattle & hogs also my stock of sheep. It is also my will & desire that my two daughters Milly & Nancy whilst they are single live with their mother and be supported out of the property herein before bequeathed to my wife to my daughter Milly I give one feather bed & furniture, to my daughter Nancy I give one feather bed and furniture I give and bequeath to my son John Burgess one hundred acres of land lying on the north side of Smiths river to be laid off as follows to wit: Beginning at Martins Cobler's corner-line on the river thence with Cobler's line in easterly course to his corner thence continuing the same course to my back line thence with said back line a sufficient distance that by running a parallel line with Cobler line to the river will include the quantity.
I also give to my son John one feather bed & furniture. To my son Thomas Burgess I give also one hundred acres to begin at whence John Burgess's lower line will strike the River, thence an easterly course with said John's line to my back-line thence with said back line a sufficient distance as by running a line parallel with said John's lower line to the river will make the quantity I also give to my son Thomas one feather bed & furniture. It is my will and desire that my unfortunate son William shall be maintained by his mother of my estate left to her as before mentioned.
It is my will & desire that my executors herein after named shall sell my negro woman named Lise and tier child major & my crop of tobacco and to collect whatsoever debts are due me & from the proceeds thereof to pay all my just debts and whatever over plus to divide equally amongst my daughters the land stock of cattle, horses, sheep, hogs & all my household and kitchen furniture after the death of my said wife Lucy Burgess I will and desire shall be divided amongst all my daughters as shall with the advancements severally made to them make them equal after a sufficient maintenance shall be made for my son William if he should out life his mother I have already given to my son John Burgess one horse worth forty dollars. As there will be a balance of land lying on the north side of the river undisposed of I will & desire that my executors value the said land & offer it to either of my sons and whichever of them takes it at the valuation shall pay the mount to my sons in such proportion as shall make all their parts equal with each other??
