The Supreme Court Case in length .. https://tinyurl.com/bdfuptjk
Supreme Court Decision A verdict for plaintiff has been delivered by Hon. Mr Justice Blair in a reserved judgment in the Supreme Court action heard last session, in which James A. Cheyne sought an order compelling Edward Kemp to complete the sale of a property at Kumeroa. The facts were that on March 25, 1931, defendant signed an agreement ot sell his property to Cheyne for £400 but on June 11 purported to rescind the agreement. In May 1922, defendant leased the property to plaintiff for five years with a compulsory purchasing clause, the price being fixed at 800. When the lease expired plaintiff could not purchase the land and defendant renewed the lease for another five years. The agreement for purchase was thus effective as from the date of expiry of the present lease. The grounds alleged as a defence to the claim were that defendant was 75 years of age, was unable to read and only able to sign his name, was lacking in reasoning power, was suffering from loss of memory in recent years, was incapable of performing a business transaction and was never willing to sell for less than £800. Plaintiff, it was alleged, took an unfair advantage of him and bought the property at an under-value. His Honour, however, considered that £800 was excessive as compared with the value of adjoining lands. Defendant gave evidence and claimed to have no recollection of any of the material facts of the case. His Honour said he suspected defendant of posing and was not by any means satisfied that he was as feeble as he claimed to be. Defendant had shown no cause why the agreement should be set aside.
