Dans la nuit du 3 au 4 novembre 1838, dirigé par François-Xavier Prieur et Chevalier de Lorimier, et en compagnie de plusieurs autres frères-chasseurs, il participe à la Bataille de Beauharnois et plus particulièrement la prise du manoir Ellice de Beauharnois. Nicolas Boyer participe également à la prise du bateau à vapeur Henry Brougham, qui selon une rumeur, est rempli de soldats anglais venant de Glengarry, et en route vers Beauharnois afin de venir assurer la protection des Loyalistes de la seigneurie de Beauharnois. Trois jours après la prise du manoir Ellice, Nicolas Boyer fait partie des 200 Patriotes dirigés par Prieur avec De Lorimier à ses côtés, quittant Beauharnois pour prêter main-forte aux Patriotes du camp Baker, à Sainte-Martine, menacés par l'approche d'un régiment d'infanterie. Trahit par des compagnons, ils sont capturés et emprisonnés dans le Moulin à farine de Beauharnois transformé en prison.
