- In the action depending betweene THOMAS PETTY and KATHARINE his Wife, one of the Daughters and Legatees of JOHN GARTON deced., and MARTHA GARTON, Mother and prochaine Amy to her Children, JOHN. RUTH & MARTHA GARTON, Plts. and ROBERT PORT and ANNA his Wife, Admrx. of JOHN HUGHES, Ear. of JOHN GARTON deced Defts., the Plts. and Defts. haveing referred the matter in difference to the arbitratrion of Capt. THOMAS GREGSON and Mr. NATHANIELL POPE, upon mature consideration thereof they ye said Capt. GREGSON and Mr. POPE do award as followeth (vizt.) that the said ROBERT PORT &c, Deft do pay unto ye said MARTHA GARTON Widdo. of the said JOHN GARTON deced, One thousand pounds of tobbo: and to the Surviveing Children of the said JOHN GARTON Two thousand pounds of tobbo: to be equally divided being in full of all theire Right and Interest to the Estate of the said JOHN GARTON deced, the Plts. and Defts. to beare an equal! part in the costs of the said suite to which award the Plts, and the Defts. agreeing; this Court doth confirme the same and do order that the said ROBERT PORT &c. Deft. to pay the above named MARTHA GARTON, Widdow of the said JOHN GARTON, One thousand pounds of tobbo: and to the surviveing Children of the said JOHN GARTON, Two thousand pounds of tobbo als. BURIAL

John Garton's land bought jointly with John Hughes in 1685 and 1696 purchases lay on what was then called Rappahannock Creek or Run, which is now called Cat Point Creek in Richmond County. This is in the northern-most third of the county. A deed of 1696 indicates that John Garton lived on the west side of Rappahannock Creek. This would likely be just north of what is now the Rappahannock River Valley National Wildlife Refuge. John and Martha may be buried in the vicinity. See deed below.

THIS INDENTURE made the first day of Janry: 1696 in the Eighth year of the Reign of our Sovereign Lord William by the grace of God of England &c., Between THO: NORTON of the County of Richmond of the one part and ELIAS WILSON the Elder, JOHN GARTON and JOHN HEWES [Hughes] of the said County of the other part Witnesseth that the said THOMAS NORTON hath for a valuable consideration in hand already by him received have granted unto the said ELIAS WILSON the Elder, JOHN GARTON and JOHN HEWES their or either of their heirs or assigns one parcell of Land containing Three hundred and fifty acres being in the County of Richmond and on the West side of RAPPAHANOCK CREEK and joining upon the Land the said GARTON and the said HEWES now liveth, the said Three hundred and fifty acres being part of a Patent of One thousand acres of Land formerly granted to ROBERT LOVELL & PATRICK NORTON dated the second of December in the year of our Lord 1663, relation being thereunto had may appear; To have and to hold the said Land with all the premisses unto the said ELIAS WILSON the Elder, JOHN GARTON and JOHN HEWES [Hughes] their heirs from henceforth and for ever more subject nevertheless to the payments of the Quitrents of the said Land the one half being One hundred seventy five acres to the only use and behoof of the said ELIAS WILSON the Elder, his heirs or assigns forever; the other half moiety to the said JOHN GARTON and JOHN HEWES their heirs and assigns forever; And furthermore I the said THOMAS NORTON do agree at any time on demand will acknowledge before his Majestys Justices of the peace of the aforesaid County this present Deed, And it is hereby declared that the said Three hundred & fifty acres of land hereby granted more or less be in the tenure and occupation of the said ELIAS WILSON the Elder, JOHN HEWES and JOHN GARTON their and either of their heirs forever as if the same had been acknowledged by fine with Proclamation thereupon and furthermore I the said THOMAS NORTON do warrant the said land from me my heirs and assigns forever from any persons laying any just claim to the same under me. "Martha Adelade Martin"

Despite fanciful claims that Martha Garton was born "Martha Adelade Martin" no one has ever provided a shred of evidence that Martha Garton was born with this name or that she was a daughter of John Martin and Christian Pettus, who are mentioned in Bill Deyo's work on Pocahontas, said to be derived in part from a Patawomeck oral history. Deyo does not mention Martha or John Garton in his work, so the connection has evidently been fabricated by genealogists eager to find a connection to Pocahontas.
