Dave Schumacher was shot and instantly killed Thursday afternoon at the home of Joe Wishert who lives on the Navidad. Schumacher was shot in the head by Joe Ellis, who is behind the bars awaiting an examining trail though he claims that killing was an accident.
Schumacher had come to Wishert's house in the morning and sleeping on the front porch. The family came in for dinner, Ellis accompanying them, but Schumacher refused to join them preferring to finish his nap. After dinner Ellis says that he picked up a gun to go hunting and un-breached it just as he stepped out of the front door. In some manner it was exploded and the entire load took effect in Schumacher's head killing him instantly.
The deceased was unmarried and was a son of Dave Schumacher, a highly respected citizen of Sublime.

The examining trail of Joe Ellis, charged with killing Dave Schumacher, Jr., will be held here Friday afternoon. Squire Frank Kubala of Moravia will preside.
NOTE: Dave Hughes' daughter Martha Ann "Mattie married Joseph A. "Joe" Wishert. Joe Ellis this subject is the nephew of Mattie & Joe Wishert, her being the half-brother of Joseph Don "Joe" Ellis Jr. and father of this Josef/Joseph H. "Joe" Ellis (May 1886). Thomas David "Dave" Schumaker (Jr.) (October 1877 – 7 July 1904 Hallettsville, Lavaca County, Texas) is the son of Johann Diederich "Dave" Schumaker Sr. and Elizabeth Ann "Annie" Hughes. Annie was the daughter of David "Dave Hughes and his first wife Lucinda M. Ruse/Reese/White. Hence: The victim and the shooter were first cousins from my calculations.

EXAMINING TRAIL
The examining trail for Lee Ellis charged with the murder of Dave Schumacher was held Friday afternoon in the county court room. Justice Frank Kubala of Moravia presiding and County Attorney Will Bagby conducting the examination. Sufficient evidence was adduced to justify the prisoner being remanded to jail without bond.
Mr. and Mrs. Joe Wishert, Dr. C. H. Letzerich of Sublime, Constable John Pargatch and a negro Pick Paine were examined by the state. It was made known that Ellis had uttered threats against the deceased and Mr. Wishert testified that when the shot was fired he heard Ellis exclaim "There, you s___ of a b____ you will never talk anymore." He and his family were at dinner at the time and Ellis had gone to the front gallery where Schumacher was sleeping, with a gun in his hand.
Ellis had no counsel and did not seem to care for any. He testified in his own behalf and stuck to the story that he first told of the occurrence being an accident.
The HERALD has no comments to make in the case and believes that it is best for the grand jury to investigate it and for Ellis to be given a trail before a jury without the public being prejudiced one way or the other. His being refused bond however gives it a bad aspect.

DOB per 1900 census. Schumaker married Araminda "Minnie" Polk on 26 September 1895, he stated he was single in the 1900 census and their son Ernest Shewmaker living with his Uncle, Drew Polk & grandmother, Fannie C Polk in 1900 census in San Saba, San Saba Co., TX. Actually location of burial not know, only placed here because his parents or buried here.
