WILL OF JOHN BARTON

In the name of God, Amen. I, John Barton, of the township of Raritan, in the county of Hunterdon and State of New Jersey, being weak in body, but of sound mind, memory and understanding, (for which blessing I most devoutly thank my God,) do make and publish this my last will and testament in manner and form following--that is to say:

First. I constitute and appoint my Son, Isaac Barton, and my Son in law, Christopher Case, Executors of this my last will and testament.

Second. It is my will and I do order that all my just debts and funeral Expenses be duly paid and satisfied as soon as conveniently can be after my decease, out of my personal Estate.

Third. I give and devise unto my son, Isaac Barton, and to his heirs and assigns forever, all my homestead farm or plantation, together with all the buildings and appurtenances thereunto belonging. Situate in the township of Raritan aforesaid & adjoins lands of Henry Seydam, Wm. Rockafellow, Miller Kline, Andrew Sheppard & others; and contains about one hundred and forty two acres more or less--but in consideration of the devise above made to my said son, Isaac, I do hereby order and direct that he shall furnish my beloved wife, Charity Barton, during her natural life, with all the necessaries of life such as a person of her age and station may reasonably require; that he shall keep her in his own family, relieve her wants in health, and nurse her in time of sickness, and do all other acts of kindness for her such as filial affection may or ought to dictate to a dutiful son. He shall likewise keep two cows for her, summer and winter, at his own expense so long as she may wish him to do so.

Fourth. I give and bequeath to my said dear wife, Charity Barton, in addition to the provisions herein before made for her in this very will, two cows, one hog, one beef two beds and sufficient bedding for the same; and as much of my household and kitchen furniture as she may deem necessary for her use.--The provisions herein made for my said dear wife, Charity Barton, are intended to be in lieu of her right of dower at common law in my Estate.

Fifth. I give and bequeath to my grandchild Nancy Barton, daughter of my son, Henry Barton, decd. when she arrives to the age of twenty one years, the sum of seventy five dollars. I also give and bequeath to my granddaughter, Hannah Barton, daughter of my said son, Henry Barton, decd. when she arrives to the age of twenty one years, the sum of twenty five dollars. The two last mentioned bequests to my said granddaughters, Nancy Barton and Hannah Barton, I order and direct to be paid to them when due, by my said Son, Isaac Barton, in consideration of the devise of Real Estate herein before made to him, my Said Son, in this my will.

Sixth. The remainder of my Real Estate, consisting of all that tract or parcel of land, now in possession of my said son, Isaac, situate in the township of Raritan aforesaid adjoining his farm, lands of Benjn Egbert and Edward Yard, containing twenty two acres more or less. Also all that tract or parcel of land, conveyed to me by my said son, Isaac and his wife, Rachel, by deed bearing even date herewith Situate in said township of Raritan, and between the two roads, the one leading from what was formerly called the "Point Tavern" to Clinton, and the other from said "Point Tavern" to the Great Swamp, adjoins lands of said Yard, James Bellis and others, and is supposed to contain about fifty acres of land more or less. I order my Executors (provided I do not sell the same during my lifetime), to sell as soon as convenient after my decease, and make and Execute good and Sufficient deed or deeds of conveyance in the law for the same to the purchaser or purchasers thereof, and the proceeds of said Sale or Sales, together with the remainder of my personal Estate, after the sale of my moveables, and the payment of my just debts, Expenses, etc., etc., I dispose of in the following manner, to wit.

One Equal fourth part or share thereof I give and bequeath to my daughter, Jemima Smith, wife of Mahlon Smith: To her, her heirs and assigns forever.

On other equal fourth part or Share thereof I give and bequeath to my daughter, Maria, wife of Peter Rake: To her, her heirs and assigns forever.

One other equal fourth part or share thereof I give and bequeath to my daughter, Nancy, wife of Christopher Case; to her, her heirs and assigns forever.

The remaining one other Equal fourth part or share thereof I give and bequeath to my grandchildren, the children of Reuben McFarson, decd. To be divided Equally among them, Share and Share alike: To them, their heirs and assigns forever.

And it is further my will that my daughter, Sarah Case, take no part of my Estate under this my last will and testament.

Seventh. It is my will and I do order that after the decease of my dear wife Charity Barton, my Executors do make sale of that part of my personal Estate which I bequeathed to her in this my will: and divide the proceeds thereof Equally between my said son, Isaac, my said daughters Jemima, Maria and Nancy, and the aforesaid children of Reuben McFarsen decd. To them, their heirs and assigns forever: The children of Reuben McFarsen, decd. to take only one share or the one fifth part of this bequest.

In Witness whereof I have hereunto set my hand and Seal the Eighth day of September in the year of our Lord Eighteen hundred and forty three.

Signed, Sealed, published, pronounced and declared by the said John Barton, to be his last will and testament in the presence of us, who at his request, and in his presence and the presence of Each other, have hereunto Subscribed our names as witnesses.
