He was the son of William W. & Elizabeth Lillard McGinnis.

I Strother J. McGinnis of the county of Warren and state of Missouri do hereby make publish and declare this as my last will and testament in the following words, viz,

First - I declare after my decease all of my just debts be paid

Second - I direct after the payment of my debts all of my remaining property both personal and real shall be the absolute property of my wife (Betsy L. McGinnis) during her natural life or during her widowhood, subject to the management of my hereinafter named Executors; and in the event of her marriage, then said property shall be subject to the control of the county court of this county to be disposed of according to law and the provisions of this will; if my family should remain in this country.

And lastly I constitute my sons Dickson D. McGinnis and Thomas M. McGinnis my Executors to execute this my last will and testament hereby revoking all former will that I may have made. In testimony whereof I hereto set my hand and cause my seal to be affixed this 13th of May A. D. 1853.

Before the undersigned clerk of the county court within and for said county appeared Sandy Pratt one of the subscribing witnesses to the foregoing last will and testament of Strother J. McGinnis, deceased who being duly sworn according to law disposes and says that he signed the name of Strother J. McGinnis to the foregoing will by request of said McGinnis that he the said Strother McGinnis acknowledged the same as and for his last will by having his name signed thereto and he declared the same as his last will that he the said Sandy Pratt signed his name as a witness in the presence of and by request of said testator and in presence of John Welch and that at the time of signing the same the said Strother J. McGinnis was of sound and disposing memory.

Before the undersigned clerk of the county court within and for said county appeared John Welch one of the subscribing witnesses to the foregoing will of Strother J. McGinnis, deceased, who being duly sworn on his oath declared that the name of Strother J. McGinnis was signed to said will by his request and in the presence of the subscribing witnesses who by his request and in his presence signed the same as witnesses, and that the said Strother J. McGinnis was at the time of signing the same of sound and disposing mind and memory.
