Lay was the son of Nicholas Newton and Catherine Hickman Prunty. In 09 Jul 1883, he married Ada "Addie" Luella Wilson. They had four children, Darius Houston Prunty, Minter Gideon Prunty, Nicholas Nay Prunty and James Lafayette Prunty. In June, 1889, he murdered a man named Wright Children with a hand spike. He was taken to prison and on 14 Apr 1898, he and another man escaped when a mob broke into the prison and let him and another man escape. He was never heard from again and is assumed to have died at that time. His death certificate does not exist.
