He was a pioneer Attorney and Civil War Veteran having been both an enlisted man and commisioned officer. Initially enlisted Malone, NY in Co H 106th Inf Rgt NY Vols becoming 1st Sgt of that unit. Some of of the engagements in which he participated included Gettysburg, Harpers Ferry, and the seige of Charleston. He was cited for his actions @ Deveaux's Neck, escaping serious wounds when struck in the back by a bullet that was blunted by his pistol case and sword belt. He received three promotions from his cmdrs including those @ Division and Brigade level. He turned down a Captaincy to accept a commission as 2nd Lt. with the 26th Inf Rgt of Colored Troops. He married his wife Abigail Towne Wescott 8 July 1861 in Chasm Falls, NY.
