His service record stated that he died Dec 15, 1862 at Camp Stewart, TN. No cause of death was listed. It is not clear whether he was buried in TN or returned home to be buried in his wife's family cemetery (Moore-Windgard)in Montgomery county, but his wife, Martha A Talley, applied to the CSA War Department on Sep 9, 1863 for his pension. Records do not show whether she received any money or not, but it does show that she knew that her husband had died.

I have placed Henry in this cemetery with his wife, children, and grand children, but no document has been found to verify this. There are several burial plot in this cemetery that have been listed just as "Talley" in surveys of the cemetery.
