He was the husband of Hannah Hungerford Foster. Jabez Foster was the father of two known daughters, Elvira and Evelina. Both daughters lived to grow up and marry. He was also the father of two sons. Both sons were named Ambrose Sylvester, and both died in early childhood. Jabez was buried in Woodland Cemetery, in the Smith lot. After much research, an article was found that stated Judge Foster's daughter Elvira returned to New York after her husband Major Smith died. At the time when his daughter was a resident of Monroe, they resided at the mansion that Major Smith built on Elm Ave. Later known as the Ilgenfritz home.
