Toliver was the son of Richard Scruggs and Salina Arvazina Hawkins. He married Temperance L. "Tempy" Simmons Matheny, the widow of Lewis Hoff Matheny. Toliver served in the Civil War. Toliver and Tempy were married over 50 years and they had at least 9 children.
